A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a voter's use of an application for a ballot to be voted |
|
by mail to update the voter's residence. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 84.002, Election Code, is amended by |
|
adding Subsection (c) to read as follows: |
|
(c) An application for a ballot to be voted by mail may |
|
indicate a change of residence address. If the voter includes a |
|
change of residence address in the voter's application, the early |
|
voting clerk shall notify the appropriate voter registrars of the |
|
change and the registrars shall update the voter's voter |
|
registration information accordingly. |
|
SECTION 2. Section 84.011, Election Code, is amended by |
|
adding Subsection (c) to read as follows: |
|
(c) The officially prescribed application form for an early |
|
voting ballot to be voted by mail must include a space for the voter |
|
to provide a change of residence address. |
|
SECTION 3. Section 86.001(e), Election Code, is amended to |
|
read as follows: |
|
(e) If the applicant does not have an effective voter |
|
registration for the election, the clerk shall reject the |
|
application unless: |
|
(1) the clerk can determine from the voter registrar |
|
that the applicant has submitted a voter registration application |
|
and the registration will be effective on election day; or |
|
(2) the voter has provided a change of residence |
|
address on the voter's application for a ballot to be voted by mail |
|
and the voter's registration will be effective on election day. |
|
SECTION 4. This Act takes effect September 1, 2015. |
