A BILL TO BE ENTITLED
 
AN ACT
  relating to the disposition of certain surplus property by the
  Department of Public Safety.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter F, Chapter 2175, Government Code, is
  amended by adding Section 2175.308 to read as follows:
         Sec. 2175.308.  EXCEPTION FOR CERTAIN DEPARTMENT OF PUBLIC
  SAFETY PROPERTY. (a)  Notwithstanding other provisions of this
  chapter, to support the mission of the Department of Public Safety,
  the department may donate or sell, at a discounted rate, directly to
  a local law enforcement agency:
               (1)  a surplus law enforcement motor vehicle; or
               (2)  other surplus law enforcement equipment,
  including radios, personal protection equipment, and weapons
  accessories.
         (b)  The Department of Public Safety:
               (1)  shall sell surplus motor vehicles and other law
  enforcement equipment under this section in its "as-is" condition;
  and
               (2)  may not make any representations or warranties as
  to the condition or use of surplus motor vehicles and other law
  enforcement equipment sold under this section.
         (c)  Revenue from the sale of motor vehicles and equipment
  under this section shall be deposited to the credit of the
  Department of Public Safety and may be appropriated only to the
  department.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2015.
