A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to fingerprinting requirements for occupational licenses. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Title 2, Occupations Code, is amended by adding |
|
Chapter 60 to read as follows: |
|
CHAPTER 60. FINGERPRINTING REQUIREMENTS |
|
Sec. 60.001. DEFINITIONS. In this chapter: |
|
(1) "License" means a license, certificate, |
|
registration, permit, or other form of authorization required by |
|
law or a state agency rule that must be obtained by an individual to |
|
engage in a particular business. |
|
(2) "State agency" means a department, board, bureau, |
|
commission, committee, division, office, council, or agency of this |
|
state. |
|
Sec. 60.002. FINGERPRINTING OF CERTAIN LICENSE APPLICANTS |
|
PROHIBITED. (a) Notwithstanding any other law and except as |
|
provided by this section, a state agency that issues a license may |
|
not require an applicant for the license to submit fingerprints to |
|
the agency, the Department of Public Safety, or any other person as |
|
a requirement for the issuance or renewal of the license. |
|
(b) This section does not apply to an applicant for a |
|
license issued under Chapter 1701 or 1702. |
|
SECTION 2. Chapter 60, Occupations Code, as added by this |
|
Act, applies only to an application for the issuance or renewal of |
|
an occupational license filed on or after the effective date of this |
|
Act. An application filed before that date is governed by the law |
|
in effect on the date the application was filed, and the former law |
|
is continued in effect for that purpose. |
|
SECTION 3. This Act takes effect September 1, 2015. |
