Pursuant to suspension of Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Open Government was held on Tuesday, May 14, 2013, at Senator Ellis' Desk.

The chair called the meeting to order at 12:42 PM. There being a quorum present, the following business was transacted:

 

The posting rule, Senate Rule 11.10 and 11.18, was suspended to hear the following bill(s):

 

The chair laid out as a matter of pending business HB 367.

 

Senator Ellis moved that HB 367 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 4 ayes, 0 nays, 0 present not voting, and 1 absent.

 

The chair laid out as a matter of pending business HB 483.

 

Senator Williams moved that HB 483 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 0 nays, 0 present not voting, and 2 absent.  

 

Senator Nelson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business HB 2267.

 

Senator Davis moved that HB 2267 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 4 ayes, 0 nays, 0 present not voting, and 1 absent.

 

Senator Nelson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business HB 2414.

 

Senator Nelson sent up a committee substitute which was previously explained by the author.

 

Senator Ellis sent up Committee Amendment 1.

 

Senator Nelson requested unanimous consent to incorporate the amendment into a committee substitute; without objection, it was so ordered. Senator Nelson then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator Nelson moved that HB 2414 do not pass but that CSHB 2414 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 4 ayes, 0 nays, 0 present not voting, and 1 absent.

 

Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

There being no further business, at 12:45 PM Senator Ellis moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
