Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Open Government was held on Monday, April 22, 2013, in the Betty King Committee Room at Austin, Texas.

The chair called the meeting to order at 7:46 PM. There being a quorum present, the following business was transacted:

 

The chair laid out as a matter of pending business SB 1368 and recognized the author, Senator Davis, to explain the bill.

 

Senator Davis sent up a committee substitute; the chair recognized Senator Davis to explain the difference between the committee substitute and the senate bill as filed. Senator Davis moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Davis moved that SB 1368 do not pass but that CSSB 1368 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 0 nays, 0 present not voting, and 2 absent.

 

Senator Davis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1882 and recognized the author, Senator Zaffirini, to explain the bill. Senator Ellis moved to reconsider the vote by which the committee substitute for SB 1882 was adopted; without objection, it was so ordered.

 

Senator Davis moved to withdraw from consideration the committee substitute that was previously considered; without objection, it was so ordered.

 

Senator Davis sent up a new committee substitute; the chair recognized committee staff to explain the difference between the new committee substitute and the senate bill as filed. Senator Davis moved adoption of the committee substitute; without objection, it was so ordered. 

 

Witnesses registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Davis moved that SB 1882 do not pass but that CSSB 1882 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 0 nays, 0 present not voting, and 2 absent.

 

At 7:50 PM Senator Davis assumed the chair.

 

The chair laid out as a matter of pending business SB 1512 and recognized the author, Senator Ellis, to explain the bill. Senator Ellis moved to reconsider the vote by which the committee substitute for SB 1512 was adopted; without objection, it was so ordered.

 

Senator Ellis moved to withdraw from consideration the committee substitute that was previously considered; without objection, it was so ordered.

 

Senator Ellis sent up a new committee substitute; the chair recognized committee staff to explain the difference between the committee substitute and the senate bill as filed. Senator Ellis moved adoption of the new committee substitute; without objection, it was so ordered. 

 

Senator Ellis moved that SB 1512 do not pass but that CSSB 1512 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 0 nays, 0 present not voting, and 2 absent.

 

Senator Ellis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

At 7:52 PM Senator Ellis resumed the chair.

 

The chair laid out SB 1896 and recognized the author, Senator Garcia, to explain the bill.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Davis moved that SB 1896 be reported favorably to the Senate with the recommendation that it do pass and be printed.

 

There being no further business, at 7:57 PM Senator Ellis moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
