Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Natural Resources was held on Tuesday, April 23, 2013, in the Capitol Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 9:06 AM. The following business was transacted:

 

The chair laid out SB 434 and recognized the author, Senator Hancock, to explain the bill.

Witnesses testifying and registering on the bill are shown on the attached list.

 

At 9:09 AM the roll was called.  A quorum was present. Senator Fraser moved to limit testimony to 3 minutes; without objection, it was so ordered.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

Senator Fraser moved that SB 434 be left pending; without objection, it was so ordered.

 

 

 

The chair laid out SB 1482 and recognized the author, Senator Watson, to explain the bill.

Senator Estes sent up a committee substitute; the chair recognized Senator Watson to explain the difference between the committee substitute and the senate bill as filed. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Estes moved adoption of the committee substitute; without objection, it was so ordered. Senator Estes moved that SB 1482 do not pass but that CSSB 1482 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 1 present not voting, and 1 absent.

 

The chair laid out SB 212 and recognized the author, Senator Nichols, to explain the bill.

Senator Estes assumed the chair.

 

Senator Fraser resumed the chair.

 

Senator Fraser moved that SB 212 be left pending; without objection, it was so ordered.

 

At 11:00 AM Senator Fraser moved that the Committee stand recessed until 15 minutes after adjournment of the Senate. Without objection, it was so ordered.

 

At 7:38 PM Senator Fraser reconvened the meeting.

 

The chair laid out as a matter of pending business SB 212.  Witness testimony continued on SB 212. The chair moved that the public testimony be closed; without objection, it was so ordered.

Senator Fraser moved that SB 212 be left pending to await a quorum; without objection, it was so ordered.

 

The chair laid out SB 1574 and recognized the author, Senator Lucio, to explain the bill.

Senator Estes sent up a committee substitute; the chair recognized Senator Lucio to explain the difference between the committee substitute and the senate bill as filed. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Estes moved adoption of the committee substitute; without objection, it was so ordered. Senator Estes moved that SB 1574 do not pass but that CSSB 1574 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 2 absent. Senator Estes moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

Senator Seliger made a Motion in Writing to be shown voting aye on the following bill:  SB 1482.  Without objection, it was so ordered.  This vote is reflected in the final vote on the aforementioned bill.

 

The chair laid out SB 514 and recognized Senator Duncan, in the absence of the author, to explain the bill. Senator Duncan sent up a committee substitute; the chair recognized Senator Duncan to explain the difference between the committee substitute and the senate bill as filed.

Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered. Senator Duncan moved that SB 514 do not pass but that CSSB 514 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 2 absent. Senator Duncan moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 434 and recognized Senator Estes, in absence of the author. Senator Estes moved that SB 434 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 2 nays, 0 present not voting, and 2 absent.

 

The chair laid out as a matter of pending business SB 212 and recognized Senator Nichols to explain the bill.

Senator Fraser was recognized to discuss Committee Amendment 1 to SB 212, sunset bill, that Senator Fraser intends to offer as a floor amendment to SB 212. Senator Fraser was then recognized to discuss Committee Amendment 2 to SB 212, sunset bill, that Senator Fraser intends to offer as a floor amendment to SB 212.

Senator Hegar was recognized to discuss Committee Amendment 3 to SB 212, sunset bill, that Senator Hegar intends to offer as a floor amendment to SB 212. Senator Estes was recognized to discuss Committee Amendment 4 to SB 212, sunset bill, that Senator Uresti intends to offer as a floor amendment to SB 212. Senator Estes was recognized to discuss Committee Amendment 5 to SB 212, sunset bill, that Senator Uresti intends to offer as a floor amendment to SB 212.

Senator Estes was recognized to discuss Committee Amendment 8 to SB 212, sunset bill, that Senator Estes intends to offer as a floor amendment to SB 212.  Senator Estes was recognized to discuss Committee Amendment 9 to SB 212, sunset bill, that Senator Estes intends to offer as a floor amendment to SB 212. Senator Ellis was recognized to discuss Committee Amendment 10 to SB 212, sunset bill, that Senator Ellis intends to offer as a floor amendment to SB 212. Senator Nichols moved that SB 212 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 2 absent.

Senator Uresti submitted a Motion in Writing requesting unanimous consent to be shown voting aye on the following bills: CSSB 1574, CSSB 514, and SB 212. Senator Uresti submitted a Motion in Writing requesting unanimous consent to be shown voting nay on the following bill: SB 434. These votes are reflected in the final votes on the aforementioned bills.

 

Senator Duncan submitted a Motion in Writing requesting unanimous consent to be shown voting aye on the following bill: CSSB 1482. This vote is reflected in the final vote on the aforementioned bill.
