Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Jurisprudence was held on Tuesday, March 12, 2013, in the Betty King Committee Room at Austin, Texas.

The Chair called the meeting to order at 1:30 PM.  There being a quorum present, the following business was transacted:

 

Senator Rodríguez moved adoption of the minutes from the previous hearing held on March 5, 2013.  Without objection, it was so ordered.

 

The Chair laid out SB 117 and recognized the author, Senator Hinojosa, to explain the bill.

 

Senator Paxton sent up a committee substitute; the Chair recognized Senator Hinojosa to explain the difference between the committee substitute and the senate bill as filed.  Senator Paxton moved adoption of the committee substitute.  Without objection, it was so ordered.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The Chair moved that the public testimony be closed.  Without objection, it was so ordered.

 

Senator West moved that CSSB 117 be left pending to await a quorum.  Without objection, it was so ordered.  Upon arrival of a quorum, Senator Garcia moved that SB 117 do not pass but that CSSB 117 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.

 

Senator Campbell moved that the bill be recommended for placement on the Local & Uncontested Calendar.  Without objection, it was so ordered.

 

The Chair laid out SB 479 and recognized the author, Senator Hinojosa, to explain the bill.

The Chair moved that the public testimony be closed.  Without objection, it was so ordered.

 

Senator Paxton moved that SB 479 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.

 

Senator Garcia moved that the bill be recommended for placement on the Local & Uncontested Calendar.  Without objection, it was so ordered.

 

The Chair laid out SB 387 and recognized the author, Senator Nichols, to explain the bill.

Senator Paxton moved that the bill be recommended for placement on the Local & Uncontested Calendar.  Without objection, it was so ordered.

 

At 2:28 PM Senator Paxton assumed the Chair.

 

The Chair laid out as a matter of pending business SB 395 and recognized the author, Senator West, who moved to reconsider the vote by with the Committee Substitute to SB 395 was previously adopted.  Without objection, it was so ordered.  Senator West then moved to withdraw the previously adopted SB 395.  Without objection, it was so ordered.

 

Senator West sent up a new committee substitute; the Chair recognized Senator West to explain the difference between the new committee substitute and the senate bill as filed.  Senator West moved adoption of the committee substitute.  Without objection, it was so ordered.

 

Senator West moved that SB 395 do not pass but that CSSB 395 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent.

 

At 2:32 PM Senator West resumed the Chair.

 

The Chair laid out SB 753 and recognized Senator Paxton, in the absence of the author, to explain the bill.

The Chair moved that the public testimony be closed.  Without objection, it was so ordered.

 

Senator West moved that SB 753 be left pending.  Without objection, it was so ordered.
