Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Finance was held on Thursday, April 25, 2013, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 1:40 PM. The clerk called roll. There being a quorum present, the following business was transacted:

 

Senator Hinojosa moved to suspend Rule 9 of the Senate Finance Committee Rules so that the Committee could take up the subcommittee reports before the 24 hour layout. Without objection, it was so ordered.

 

The subcommittee report on SB 163 was laid out by Senator Hegar. Senator Hegar was recognized to explain the subcommittee report on SB 163.

The chair laid out as a matter of pending business SB 1808 and recognized the author, Senator Schwertner, to explain the bill.

 

Senator Hinojosa moved to pull down the committee substitute sent up at a previous hearing. There was no objection.

 

Senator Huffman sent up a committee substitute; the chair recognized Senator Schwertner to explain the difference between the committee substitute and the senate bill as filed. Senator Williams moved adoption of the committee substitute; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SJR 61.

 

Senator Williams moved adoption of the committee substitute that was sent up at a previous hearing; without objection, it was so ordered.

 

The chair recognized Senator Schwertner to explain the difference between the committee substitute and the senate bill as filed.

 

Senator Zaffirini sent up a committee substitute to SB 163 and moved adoption; without objection, it was so ordered. The chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed.

 

Senator Hegar moved that SB 163 do not pass but that CSSB 163 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 11 ayes, 0 nays, 0 present not voting, and 4 absent.

 

The subcommittee report on SB 1606 was laid out by Senator Hegar. Senator Zaffirini was recognized to explain the subcommittee report on SB 1606.

 

Senator Zaffirini moved that SB 1606 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 11 ayes, 0 nays, 0 present not voting, and 4 absent.

 

Senator Zaffirini moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The subcommittee report on SJR 16 was laid out by Senator Hegar.

 

Senator Hegar sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed. Senator Williams moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Zaffirini moved that SJR 16 do not pass but that CSSJR 16 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 12 ayes, 0 nays, 0 present not voting, and 3 absent.

 

Senator Patrick moved that SB 1808 do not pass but that CSSB 1808 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 1 nay, 0 present not voting, and 5 absent.

 

Senator Zaffirini moved to reconsider the vote on SB 1808.  Without objection, it was so ordered.

 

Senator Patrick moved that SB 1808 do not pass but that CSSB 1808 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 3 nay, 0 present not voting, and 3 absent.

 

Senator Patrick moved that SJR 61 do not pass but that CSSJR 61 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 3 nays, 0 present not voting, and 3 absent. 

 

The subcommittee report on SB 1662 was laid out by Senator Hegar. Senator Eltife was recognized to explain the subcommittee report on SB 1662.

 

Senator Eltife moved that SB 1662 do not pass but that CSSB 1662 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 12 ayes, 0 nays, 0 present not voting, and 3 absent.

 

The chair laid out as a matter of pending business SB 101 and SJR 10 and recognized the author, Senator Patrick, to explain the bills.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

Senator Patrick sent up a committee substitute for SJR 10; the chair recognized Senator Patrick to explain the difference between the committee substitute and the senate bill as filed. Senator Williams moved adoption of the committee substitute; without objection, it was so ordered.

Senator Patrick moved that SJR 10 do not pass but that CSSJR 10 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 10 ayes, 3 nays, 0 present not voting, and 2 absent.

 

Senator Patrick sent up a committee substitute for SB 101; the chair recognized Senator Patrick to explain the difference between the committee substitute and the senate bill as filed. Senator Williams moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Patrick moved that SB 101 do not pass but that CSSB 101 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 10 ayes, 3 nays, 0 present not voting, and 2 absent.

 

Senator Nelson submitted a motion in writing asking to be shown voting aye on SB 163, SB 1606, SB 1662, SJR 16, SB 101, SB 1808, SJR 10 and SJR 61. There was no objection.

 

Senator Lucio submitted a motion in writing asking to be shown voting aye on SJR 16 and SB 1662. He asked to be shown voting nay on SB 1808, SJR 61, SJR 10 and SB 101. There was no objection.

 

Senator Seliger submitted a motion in writing asking to be shown voting aye on SB 1662, SB 101, SJR 10, SB 1606 and SJR 16.   

 

There being no further business, at 2:09 PM Senator Williams moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
