Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Thursday, April 25, 2013, in the Capitol Extension, Room E1.028, at Austin, Texas.

Senator Seliger called the meeting to order at 8:05 AM. There being a quorum present, the following business was transacted:

 

Senator Seliger moved adoption of the minutes from the previous hearings held on April 16, and April 23, 2013; without objection, it was so ordered.

 

At 8:06 AM Senator Patrick assumed the chair.

 

The chair laid out SB 783 and recognized Senator Van de Putte, in the absence of the author, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. 

 

At 8:28 AM Senator Seliger assumed the chair. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Seliger moved that SB 783 be left pending; without objection, it was so ordered.

 

At 8:30 AM Senator Taylor assumed the chair.

 

The chair laid out SB 1608 and recognized the author, Senator Van de Putte, to explain the bill.  Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Taylor moved that SB 1608 be left pending; without objection, it was so ordered.  

 

The chair laid out SB 38 and recognized the author, Senator Zaffirini, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Taylor moved that SB 38 be left pending; without objection, it was so ordered.

 

At 9:18 AM Senator Patrick resumed the chair.

 

The chair laid out SB 39 and recognized the author, Senator Zaffirini, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Patrick moved that SB 39 be left pending; without objection, it was so ordered.

 

There being no further business, at 9:29 AM Senator Patrick moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.

 

Pursuant to the suspension of Senate Rules 11.10 and 11.18 at 1:15 PM the committee

reconvened at Senator Patrick’s desk.

 

The clerk called the roll. There being a quorum present the following business was

transacted:  

 

The chair laid out as a matter of pending business SB 38 by Senator Zaffirini.  Senator Campbell moved that SB 38 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.

 

Senator Campbell moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 39 by Senator Zaffirini.  Senator Seliger moved that SB 39 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.

 

The chair laid out as a matter of pending business SB 783 by Senator Hinojosa. 

 

At 1:18 PM Senator Seliger assumed the chair. 

 

Senator Patrick sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.

 

At 1:19 PM Senator Patrick resumed the chair.  

 

Senator Seliger requested unanimous consent to incorporate adopted amendment 1 into the bill to create a committee substitute; without objection, it was so ordered.  Senator Seliger moved adoption of the new committee substitute; without objection, it was so ordered. Senator Seliger moved that SB 783 do not pass but that CSSB 783 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 3 nays, 0 present not voting, and 1 absent.

 

There was no action taken for the following bill(s): SB 317

 

There being no further business, at 1:20 PM Senator Patrick moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
