Pursuant to a notice posted on February 13, 2013, the House Committee on Calendars met in a formal meeting and was called to order by the chair, Representative Hunter, at 4:01 p.m.

 

The initial quorum call was answered as follows: Representatives Hunter; Lucio III; Alonzo; Cook; Crownover; Davis, Sarah; Eiland; Frullo; Geren; Giddings; Kuempel; and Miller, Doug.

 

A quorum was present.

 


 

The chair moved to reconsider the vote by which H.B. 10 was placed on the Major State Calendar for Thursday, February 21, 2013 when the house convenes at 10:00 a.m.  The motion to reconsider prevailed without objection.

 

The chair moved to reconsider the vote by which the proposed calendar rule to H.B. 10 was adopted for floor consideration.  The motion to reconsider prevailed without objection.

 

Representative Hunter moved to place the following measure: 

 

on the Emergency Calendar for Thursday, February 21, 2013 when the house convenes at 10:00 a.m.:  H.B. 10.

 

The motion prevailed by the following record vote:

 

Ayes:                           Representatives Hunter; Lucio III; Alonzo; Cook; Crownover; Davis, Sarah; Eiland; Frullo; Geren; Giddings; Kuempel; Miller, Doug (12).

 

Nays:                           None (0).

 

Present, Not Voting:   None (0).

 

Absent:                        Representatives Alvarado; Branch; Button (3).

Pursuant to House Rule 3, Section 4(2), and House Rule 6, Section 16(f), the House Committee on Calendars proposes the following rule governing floor consideration of H.B. 10:

Section 1. All original amendments that will be offered during second reading consideration of the bill must be filed with the chief clerk by 5:00 p.m. on Monday, February 18, 2013.

Section 2. (a) During second and third reading consideration of the bill, any amendment that adds or increases an item of appropriation in the bill is not in order unless the amendment contains an equal or greater reduction in one or more items of appropriation in the bill from the fund or funds against which the appropriation is to be certified.
(b) The provisions of this section do not apply to an amendment that makes an adjustment in an item of appropriations solely to correct a technical clerical error.

 

Representative Hunter moved to adopt the proposed rule for floor consideration on HB 10. The motion prevailed by the following record vote:
