  S.B. No. 1473
 
 
 
 
AN ACT
  relating to the chief executive officer of the Hopkins County
  Hospital District and to the delegation of certain authority by the
  district's board of directors to the chief executive officer.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 1043.059, Special District Local Laws
  Code, is amended by amending Subsection (a) and adding Subsection
  (a-1) to read as follows:
         (a)  The board may employ an [a general manager,] attorney,
  bookkeeper, and architect.
         (a-1)  The board may delegate to the chief executive officer
  the authority to hire, terminate, and make all other personnel
  decisions relating to district employees.
         SECTION 2.  Subchapter B, Chapter 1043, Special District
  Local Laws Code, is amended by adding Section 1043.062 to read as
  follows:
         Sec. 1043.062.  CHIEF EXECUTIVE OFFICER. (a)  The board
  shall appoint a qualified person as the chief executive officer of
  the district.
         (b)  The chief executive officer serves at the will of the
  board and is entitled to the compensation determined by the board.
         (c)  Subject to the limitations prescribed by the board, the
  chief executive officer shall:
               (1)  supervise the work and activities of the district;
  and
               (2)  direct the affairs of the district.
         (d)  If the board delegates to the chief executive officer
  the authority to hire, terminate, and make all other personnel
  decisions relating to district employees, the chief executive
  officer has exclusive authority over personnel matters and the
  board may not participate in or make any decisions regarding the
  employment of district employees other than the chief executive
  officer.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
