A BILL TO BE ENTITLED
 
AN ACT
  relating to creating the offense of voyeurism; providing a penalty.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 21, Penal Code, is amended by adding
  Section 21.16 to read as follows:
         Sec. 21.16.  VOYEURISM.  (a)  A person commits an offense if,
  with the intent to arouse or gratify the sexual desire of any
  person, the actor observes another person without the other
  person's consent by looking:
               (1)  through a window or other opening in a:
                     (A)  dwelling on private property:
                           (i)  while the actor is on the premises of
  the private property; or
                           (ii)  with binoculars, a telescope, or
  another similar device while the actor is on the premises of a place
  the actor is legally authorized to be; or
                     (B)  guest room of a hotel or other facility for
  the accommodation of transient guests, other than a room in which
  the actor is legally authorized to be, while the actor is on the
  premises of the hotel or other facility; or
               (2)  into an area that is designed to provide privacy to
  another person using the area, such as a restroom or shower stall or
  changing or dressing room while the actor is on the premises of a
  public place.
         (b)  An offense under this section is a Class B misdemeanor.
         SECTION 2.  This Act takes effect September 1, 2013.
