A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to creating the offense of voyeurism; providing a penalty. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 21, Penal Code, is amended by adding |
|
Section 21.16 to read as follows: |
|
Sec. 21.16. VOYEURISM. (a) A person commits an offense if, |
|
with the intent to arouse or gratify the sexual desire of any |
|
person, the actor observes another person without the other |
|
person's consent by looking: |
|
(1) through a window or other opening in a: |
|
(A) dwelling on private property: |
|
(i) while the actor is on the premises of |
|
the private property; or |
|
(ii) with binoculars, a telescope, or |
|
another similar device while the actor is on the premises of a place |
|
the actor is legally authorized to be; or |
|
(B) guest room of a hotel or other facility for |
|
the accommodation of transient guests, other than a room in which |
|
the actor is legally authorized to be, while the actor is on the |
|
premises of the hotel or other facility; or |
|
(2) into an area that is designed to provide privacy to |
|
another person using the area, such as a restroom or shower stall or |
|
changing or dressing room while the actor is on the premises of a |
|
public place. |
|
(b) An offense under this section is a Class B misdemeanor. |
|
SECTION 2. This Act takes effect September 1, 2013. |
