  H.B. No. 2259
 
 
 
 
AN ACT
  relating to circumstances under which a vacancy on the governing
  body occurs in certain municipalities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 22.041, Local Government Code, is
  amended by adding Subsection (c) to read as follows:
         (c)  In addition to an absence described by Subsection (b), a
  member of a governing body is also considered absent for the
  purposes of that subsection if the member is not present at the
  adjournment of a meeting at which a quorum is established, unless
  the member is first allowed to withdraw by the unanimous vote of the
  members present. This subsection applies only to a municipality
  that is located in a county with a population of 800,000 or more
  that is adjacent to an international border.
         SECTION 2.  The change in law made by this Act applies only
  to a meeting held on or after the effective date of this Act.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2013.
