A BILL TO BE ENTITLED
 
AN ACT
  re
  lating to the continuation of the Texas Women's Health Program.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 32 of the Human Resources Code is amended
  as follows:
         Section 32.021  (b-1) The department shall immediately apply
  for federal funds in the form of a Section 1115 Medicaid Waiver if
  the department ceases operation of the program under Section
  39.45(d) of this Code.
         (b-2)  It is the Legislature's intent that the application
  under Section 32.021(b-1) be identical to what was made under the
  former federal Medicaid Women's Health Program, which ceased
  operations December 31, 2012.
         SECTION 2.  This Act takes immediate effect immediately if
  it receives a vote of two-thirds of all members elected to each
  house, as provided by Section 39, Article III, Texas Constitution.  
  If this Act does not receive the vote necessary for immediate
  effect, this Act takes effect September 1, 2013.
