Amend CSHB 7 (house committee printing) as follows:
(1) On page 11, line 6, strike "comptroller may require that the department [shall]" and substitute "department shall".
(2) On page 11, line 17, strike "the additional $5 collected in fees that is" and substitute "fees".
(3) On page 12, strike line 4 and substitute:
be remitted under this subsection on the condition that the Texas Commission on Environmental Quality, after a public hearing, finds that the use of the funds for those purposes will be at least as effective as other eligible uses of those funds under the Texas emissions reduction plan in maintaining or attaining compliance with the federal Clean Air Act and notifies the Texas Transportation Commission of that finding. Unless that condition is met, the amounts shall be deposited to the credit of the Texas emissions reduction plan fund.
