Pursuant to suspension of Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Friday, May 13, 2011, at Senator Whitmire's Desk.

The chair called the meeting to order at 3:06 PM. There being a quorum present, the following business was transacted:

 

As a matter of pending business the chair laid out HB 260. Senator Hinojosa moved that HB 260 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent.

 

As a matter of pending business the chair laid out HB 1451. Senator Whitmire sent up a committee substitute. Senator Whitmire moved adoption of the committee substitute; without objection, it was so ordered. Senator Hinojosa moved that HB 1451 do not pass but that CSHB 1451 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.

 

As a matter of pending business the chair laid out HB 1658. Senator Carona sent up a committee substitute; the chair recognized Senator Carona to explain the difference between the committee substitute and the house bill as engrossed. Senator Carona moved adoption of the committee substitute; without objection, it was so ordered. Senator Carona moved that HB 1658 do not pass but that CSHB 1658 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nays, 0 present not voting, and 1 absent. Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business the chair laid out HB 3459. Senator Hinojosa requested unanimous consent to incorporate the amendments into the committee substitute; without objection, it was so ordered. Senator Hinojosa then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Hinojosa moved that HB 3459 do not pass but that CSHB 3459 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 0 nays, 0 present not voting, and 2 absent. Senator Carona moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

 

 

There being no further business, Senator Whitmire moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
