Pursuant to suspension of Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Jurisprudence was held on Wednesday, April 13, 2011, at Senator Harris's Desk.

The chair called the meeting to order at 3:25 PM. There being a quorum present, the following business was transacted:

 

The following members arrived after the roll was called: Senator Huffman

 

The chair laid out as a matter of pending business SB 220 and recognized the author, Senator Nelson, to explain the bill.

 

Senator Harris sent up a committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed. Senator Harris moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Harris sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.

 

Senator Harris requested unanimous consent to incorporate the amendment into a new committee substitute; without objection, it was so ordered. Senator Harris then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator Rodriguez moved that SB 220 do not pass but that new CSSB 220 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 0 absent. Senator Huffman submitted a motion in writing requesting unanimous consent to be shown voting Aye on CSSB 220.

 

Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1159.

 

Senator Harris sent up a committee substitute; the chair recognized Senator Harris to explain the difference between the committee substitute and the senate bill as filed. Senator Harris moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Harris moved that SB 1159 do not pass but that CSSB 1159 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 0 absent. Senator Huffman submitted a motion in writing requesting unanimous consent to be shown voting Aye on CSSB 1159.

 

Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1551.

 

Senator Harris sent up a committee substitute; the chair recognized Senator Rodriguez to explain the difference between the committee substitute and the senate bill as filed. Senator Harris moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Rodriguez moved that SB 1551 do not pass but that CSSB 1551 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 0 absent. Senator Huffman submitted a motion in writing requesting unanimous consent to be shown voting Aye on CSSB 1551.

 

Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1682.

 

Senator Harris moved that SB 1682 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 1 nay, 0 present not voting, and 0 absent. Senator Huffman submitted a motion in writing requesting unanimous consent to be shown voting Aye on SB 1682.

 

The chair laid out as a matter of pending business SB 723.

 

Senator Harris moved that SB 723 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 4 ayes, 2 nays, 1 present not voting, and 0 absent.
