Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Finance was held on Thursday, May 19, 2011, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 9:05 AM. The following business was transacted:

 

Senator Hinojosa assumed the chair.

 

The chair laid out HB 2810 and recognized the Senate sponsor, Senator Estes, to explain the bill.

 

Senator Estes sent up a committee substitute; the chair recognized Senator Estes to explain the difference between the committee substitute and the house bill as engrossed.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Hinojosa moved that HB 2810 be left pending; without objection, it was so ordered.

 

The chair laid out HB 2383 and recognized Senator Estes, in the absence of the Senate sponsor, to explain the bill.

At 9:22 AM Senator Hinojosa moved that the Committee stand recessed until 10:00 AM. Without objection, it was so ordered.

 

At 10:01 AM the Committee reconvened.

 

Senator Hinojosa resumed the chair.

 

The chair laid out as a matter of pending business HJR 109 and recognized the Senate sponsor, Senator Ogden, to explain the bill.

 

Senator Ogden sent up a committee substitute; the chair recognized Senator Ogden to explain the difference between the committee substitute and the house bill as engrossed.

 

The clerk called roll. There was a quorum present.

 

Senator Ogden moved adoption of the committee substitute for HJR 109; without objection, it was so ordered. 

 

Senator Ogden moved that HJR 109 do not pass but that CSHJR 109 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 11 ayes, 0 nays, 0 present not voting, and 4 absent.

 

The chair laid out HB 3647 and recognized the Senate sponsor, Senator Ogden, to explain the bill.

 

Senator Ogden moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Ogden moved that HB 3647 do not pass but that CSHB 3647 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 11 ayes, 0 nays, 0 present not voting, and 4 absent.

 

Senator Ogden resumed the chair.

 

The chair laid out HB 2810 and recognized the Senate sponsor, Senator Estes, to explain the bill.

 

Senator Estes moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Estes moved that HB 2810 do not pass but that CSHB 2810 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 10 ayes, 0 nays, 0 present not voting, and 5 absent.

 

Senator Estes moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out HB 2383 and recognized Senator Hinojosa, in the absence of the Senate sponsor, to explain the bill.

 

Senator Hinojosa moved that HB 2383 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 10 ayes, 0 nays, 0 present not voting, and 5 absent.

 

Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out HB 2169 and recognized the Senate sponsor, Senator Shapiro, to explain the bill.

 

Senator Shapiro moved that HB 2169 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 10 ayes, 0 nays, 0 present not voting, and 5 absent.

 

The chair laid out HB 1732 and recognized the Senate sponsor, Senator Hinojosa, to explain the bill.

 

Senator Hinojosa moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Hinojosa moved that HB 1732 do not pass but that CSHB 1732 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 1 nay, 0 present not voting, and 5 absent.

 

Senator Lucio submitted a motion in writing and asked to be shown voting aye on the following bills: HB 1732, HB 2169, HB 2383 and HB 2810. Without objection, it was so ordered.
