Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, April 26, 2011, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:31 AM. The following business was transacted:

 

The chair laid out HB 1555 and recognized the Senate sponsor, Senator Ellis, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Shapiro moved that HB 1555 be left pending; without objection, it was so ordered.    

 

As a matter of pending business, the chair laid out SB 1557 and recognized Senator Seliger, in the absence of the author, to explain the bill.  Senator Seliger sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the senate bill as filed.  Senator Seliger sent up Committee Amendment 1 and explained the amendment.  Upon arrival of a quorum, Senator Seliger moved adoption of amendment 1; without objection, the amendment was adopted.  Senator Seliger requested unanimous consent to incorporate the adopted amendment into the proposed committee substitute; without objection, it was so ordered. 

 

At 8:48 AM the roll was called, and a quorum was present.

 

Senator Shapiro moved to withdraw from consideration the substitute for SB 1557 that was sent up on a previous date; without objection, it was so ordered.  Senator Seliger then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Seliger moved that SB 1557 do not pass but that CSSB 1557 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nays, 1 present not voting, and 1 absent.

 

The chair laid out SB 66 and recognized the author, Senator Zaffirini, to explain the bill.  Senator Seliger sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Gallegos, Jr. moved adoption of the committee substitute; without objection, it was so ordered.  Senator Gallegos, Jr.  moved that SB 66 do not pass but that CSSB 66 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Gallegos, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out HB 861 and recognized the Senate sponsor, Senator Davis, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Van de Putte moved that HB 861 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out HB 1555.  Senator West sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Senator Shapiro requested unanimous consent to incorporate the adopted amendment into the bill to create a committee substitute; without objection, it was so ordered. Senator Shapiro then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Shapiro moved that HB 1555 do not pass but that CSHB 1555 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 1 nay, 0 present not voting, and 1 absent.

 

Senator Carona requested unanimous consent to be shown voting aye on SB 66, HB 861, and SB 1557; there being no objection, it was so ordered.

 

Senator Davis requested unanimous consent to be shown voting aye on HB 1555; there being no objection, it was so ordered.

 

There being no further business, at 9:30 AM Senator Shapiro moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
