Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Education was held on Thursday, April 14, 2011, in the Capitol Extension, Room E1.028, at Austin, Texas.

Pursuant to the suspension of Senate Rules 11.10 and 11.18 during the Senate session of

April 13th, 2011, the chair considered the following bill, SB 12.

 

The chair called the meeting to order at 8:33 AM. The following business was transacted:

The chair laid out SB 224 and recognized the author, Senator Nelson, to explain the bill.  Senator West sent up a committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Shapiro moved that SB 224 be left pending; without objection, it was so ordered.

 

The chair laid out SB 89 and recognized the author, Senator Lucio, to explain the bill.  Senator Van de Putte sent up a committee substitute; the chair recognized Senator Lucio to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

SB 89 was left pending temporarily.

 

At 8:56 AM the roll was called, and a quorum was present.

 

Senator Patrick moved adoption of the minutes from the previous hearings held on March 1st, March 8th, March 22nd,  March 23rd, March 29th, March 31st, April 5th, April 7th, and April 12th, 2011; without objection, it was so ordered.

 

As a matter of pending business, Senator Van de Putte moved adoption of the committee substitute to SB 89; without objection, it was so ordered.  Senator Van de Putte moved that SB 89 do not pass but that CSSB 89 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.

 

As a matter of pending business, the chair laid out SB 224.  Senator Patrick moved adoption of the committee substitute previously sent up; without objection, it was so ordered.  Senator Patrick moved that SB 224 do not pass but that CSSB 224 be reported back to the Senate with the recommendation that it do pass and be printed.   The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out SB 1511 and recognized the author, Senator West, to explain the bill.  Senator West sent up a committee substitute; the chair recognized Senator West to explain the difference between the committee substitute and the senate bill as filed.  Senator West sent up Committee Amendment 1 to the proposed substitute and explained the amendment.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator West moved adoption of amendment 1; without objection, the amendment was adopted.  Senator West moved adoption of the committee substitute; without objection, it was so ordered.  Senator West requested unanimous consent to

incorporate the amendment into the committee substitute; without objection, it was so ordered.  Senator Patrick moved that SB 1511 do not pass but that CSSB 1511 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.

 

At 9:21 AM Senator Seliger assumed the chair.

 

The chair laid out SB 12 and recognized the author, Senator Shapiro, to explain the bill.  Senator Patrick sent up Committee Amendment 1 and explained the amendment.  Senator Davis moved adoption of Amendment 1; without objection, it was so ordered.  Senator Davis moved that Amendment 1, be incorporated into the bill to create a substitute and that the committee substitute be adopted; without objection, it was so ordered.  Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Davis moved that SB 12 do not pass but that CSSB 12 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 5 ayes, 2 nays, 0 present not voting, and 2 absent.

 

At 10:21 AM, Senator Seliger moved that the committee stand recessed subject to the call of the chair; without objection, it was so ordered.

At 2:39 PM Senator Patrick assumed the chair.

 

As a matter of pending business, the chair laid out SB 518.  Senator Shapiro moved to withdraw from consideration the substitute and amendment for SB 518 that was previously sent up; without objection, it was so ordered.  Senator Shapiro sent up a new committee substitute; the chair recognized Senator Shapiro to explain the difference between the committee substitute and the senate bill as filed. Senator Shapiro moved adoption of the committee substitute; without objection, it was so ordered.  Senator Shapiro moved that SB 518 do not pass but that CSSB 518 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.

 

As a matter of pending business, the chair laid out SB 570.  Senator Shapiro moved to reconsider the vote by which the amendment for SB 570 was adopted previously; without objection, it was so ordered.  Senator Shapiro moved to withdraw from consideration the amendment for SB 570 that was adopted previously; without objection, it was so ordered.  Senator Shapiro sent up a new committee substitute; the chair recognized Senator Shapiro to explain the difference between the committee substitute and the senate bill as filed. Senator Shapiro moved adoption of the committee substitute; without objection, it was so ordered.  Senator Shapiro moved that SB 570 do not pass but that CSSB 570 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.

Senator Shapiro moved adoption of the committee substitute; without objection, it was so ordered.  Senator Shapiro moved that SB 1383 do not pass but that CSSB 1383 be reported back to the Senate with the recommendation that it do pass and be printed. As a matter of pending business, the chair laid out SB 1872.  Senator Van de Putte requested unanimous consent to incorporate the amendments previously adopted into the proposed substitute to create a new committee substitute; without objection, it was so ordered.  Senator Patrick moved adoption of the committee substitute; without objection, it was so ordered. Senator Patrick moved that SB 1872 do not pass but that CSSB 1872 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.   

 

As a matter of pending business, the chair laid out SB 205.  Senator West moved adoption of the committee substitute previously sent up; without objection, it was so ordered.  Senator West moved that SB 205 do not pass but that CSSB 205 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nays, 0 present not voting, and 2 absent.

 

Senator Davis requested unanimous consent to be shown voting aye on SB 89, and SB

224; there being no objection, it was so ordered.

 

Senator Gallegos, Jr. requested unanimous consent to be shown voting aye on SB 89, SB

224, and SB 1511; there being no objection, it was so ordered.
