the Senate Committee on Education was held on Tuesday, March 1, 2011, in the Capitol

Extension, Room E1.028, at Austin, Texas.

Pursuant to the suspension of Senate Rules 11.10 and 11.18 during the Senate session of February 28th, 2011, the Chair considered the following bill, SB 912.

 

The chair called the meeting to order at 8:40 AM. The following business was transacted:

 

The chair laid out SB 79 and recognized the author, Senator Nelson, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 79 be left pending; without objection, it was so ordered.

 

The chair laid out SB 155 and recognized the author, Senator Huffman, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 155 be left pending; without objection, it was so ordered.

Senator Gallegos, Jr.  moved that SB 912 be left pending; without objection, it was so ordered.

 

At 9:17 AM Senator Patrick assumed the chair.

 

The chair laid out SB 140 and recognized the author, Senator Shapiro, to explain the bill. Senator Shapiro sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.

Senator Patrick sent up Committee Amendment 1.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Shapiro moved that SB 391 be left pending; without objection, it was so ordered.

 

At 9:30 AM Senator Patrick assumed the chair.

 

The chair laid out SB 570 and recognized the author, Senator Shapiro, to explain the bill. Senator Shapiro sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Patrick moved that SB 570 be left pending; without objection, it was so ordered.

 

The chair laid out SB 596 and recognized the author, Senator Shapiro, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be left pending without objection, it was so ordered. 

 

As a matter of pending business Senator Shapiro requested unanimous consent to incorporate amendment 1 into the committee substitute to SB 140; without objection, it was so ordered. Senator Shapiro then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator Shapiro moved that SB 140 do not pass but that CSSB 140 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

As a matter of pending business Senator Shapiro moved that SB 912 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent. 

 

At 10:08 AM Senator Shapiro resumed the chair.

 

As a matter of pending business Senator Patrick moved that SB 79 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Davis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.  

 

As a matter of pending business Senator Patrick moved that SB 155 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.  

 

As a matter of pending business the chair brought up Committee Amendment 1 to SB 391 and moved adoption; without objection, the amendment was adopted.  Senator West requested unanimous consent to incorporate the amendment into the committee substitute; without objection, it was so ordered. Senator West then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator West moved that SB 391 do not pass but that CSSB 391 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nays, 0 present not voting, and 1 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

At 10:11 AM Senator Patrick assumed the chair.

Senator Carona requested unanimous consent to be shown voting aye on SB 79, SB 140, SB 155, SB 391, and SB 912; there being no objection, it was so ordered.
