Pursuant to suspension of Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Business & Commerce was held on Wednesday, May 18, 2011, at Senator Carona's Desk.

The chair called the meeting to order at 2:13 PM. There being a quorum present, the following business was transacted:

 

The chair laid out HB 1020 and recognized the Senate sponsor, Senator Davis, to explain the bill.

 

There being no one present wishing to provide oral testimony for, on, or against on HB 1020,

Senator Carona moved that HB 1020 be left pending; without objection, it was so ordered.

 

The chair laid out HB 2603 and recognized the Senate sponsor, Senator Hegar, to explain the bill.

 

Senator Jackson sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the senate bill as filed. Senator Jackson moved adoption of the committee substitute; without objection, it was so ordered.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Estes moved that HB 2603 do not pass but that CSHB 2603 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 2 nays, 0 present not voting, and 0 absent.

 

Senator Estes moved to reconsider the vote by which CSHB 3453 was recommended to the local and uncontested calendar; without objection, it was so ordered.

 

Senator Harris moved to reconsider the vote by which CSHB 3453 passed; without objection, it was so ordered.

 

Senator Eltife sent up a committee substitute; the chair recognized Senator Eltife to explain the difference between the committee substitute and the senate bill as filed. Senator Eltife moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Eltife moved that HB 3453 do not pass but that CSHB 3453 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator Eltife moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

At 2:24 p.m. Senator Van de Putte assumed the chair.

 

The chair called up HB 2490 as an item of pending business.

 

Senator Carona sent up a committee substitute; the chair recognized Senator Carona to explain the difference between the committee substitute and the senate bill as filed. Senator Carona moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Carona moved that HB 2490 do not pass but that CSHB 2490 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 3 nays, 0 present not voting, and 0 absent.

 

The chair called up HB 3595 as an item of pending business.

 

Senator Carona sent up a committee substitute; the chair recognized Senator Carona to explain the difference between the committee substitute and the senate bill as filed. Senator Carona moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Carona moved that HB 3595 do not pass but that CSHB 3595 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 3 nays, 0 present not voting, and 0 absent.

 

At 2:28 p.m. Senator Carona resumed the chair.
