A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the declaration of local disaster. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 418.108(i), Chapter 418, Government |
|
Code, is amended to read as follows: |
|
(i) A declaration under this section may, include a |
|
restriction that exceeds a restriction authorized by Section |
|
352.051, Local Government Code, if the Keetch-Byram Index level in |
|
Section 352.051(a)(2), Local Government Code, is exceeded and the |
|
governor has suspended the sale, dispensing, or transportation of |
|
the items in Section 418.019 within the county. A restriction that
|
|
exceeds a restriction authorized by Section 352.051(c), local |
|
Government Code, is effective only: |
|
(1) for 60 hours unless extended by the governor; and |
|
(2) if the county judge requests the governor to grant |
|
an extension of the restriction. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2011. |
