A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to processing applications for certain alcoholic beverage |
|
|
licenses or permits. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 11, Alcoholic Beverage |
|
|
Code, is amended by adding Section 11.311 to read as follows: |
|
|
Sec. 11.311. TIME FOR PROCESSING APPLICATIONS. (a) Not |
|
|
later than the 30th day after the date the commission receives an |
|
|
application for a permit, the commission shall notify the applicant |
|
|
if the application is incomplete. |
|
|
(b) Not later than the 90th day after the date the |
|
|
commission receives a completed application for a permit, the |
|
|
commission shall approve or deny the application and notify the |
|
|
applicant of the commission's decision. |
|
|
SECTION 2. Subchapter B, Chapter 61, Alcoholic Beverage |
|
|
Code, is amended by adding Section 61.331 to read as follows: |
|
|
Sec. 61.331. TIME FOR ACTION BY COMMISSION OR |
|
|
ADMINISTRATOR. The commission's or administrator's decision to |
|
|
issue or refuse to issue a license under Section 61.33 must be made |
|
|
not later than the 90th day after the date the commission receives a |
|
|
report under Section 61.32(b) certifying that the license |
|
|
application was approved by the county judge. |
|
|
SECTION 3. This Act takes effect September 1, 2011. |
