A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to annual renewal of a Texas windstorm insurance policy. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2210.203(c), Insurance Code, is amended |
|
|
to read as follows: |
|
|
(c) A policy is automatically [may be] renewed annually [on
|
|
|
application for renewal] as long as the property continues to be |
|
|
insurable property, or until canceled as provided by Section |
|
|
2210.204. The association may require evidence that the property is |
|
|
covered by a flood insurance policy in accordance with Subsection |
|
|
(a-1) before the renewal is effective. |
|
|
SECTION 2. Section 2210.203(c), Insurance Code, as amended |
|
|
by this Act, applies only to an insurance policy that is delivered, |
|
|
issued for delivery, or renewed on or after January 1, 2012. A |
|
|
policy delivered, issued for delivery, or renewed before January 1, |
|
|
2012, is governed by the law as it existed immediately before the |
|
|
effective date of this Act, and that law is continued in effect for |
|
|
that purpose. |

|
SECTION 3. This Act takes effect September 1, 2011. |
