H.B. No. 1488
 
 
 
 
AN ACT
  relating to examinations for hiring in certain municipal fire
  departments.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 143.025, Local Government Code, is
  amended by amending Subsection (b) and adding Subsection (l) to
  read as follows:
         (b)  An eligibility list for a beginning position in the fire
  or police department may be created only as a result of a
  competitive examination held in the presence of each applicant for
  the position, except as provided by Subsections (d), [and] (e), and
  (l). The examination must be based on the person's general
  knowledge and aptitude and must inquire into the applicant's
  general education and mental ability. A person may not be appointed
  to the fire or police department except as a result of the
  examination.
         (l)  In a municipality with a population of more than 1.3
  million and less than 2 million, an examination for a beginning
  position in the fire department may include testing instruments to
  be used in addition to the written examination in the establishment
  of the initial eligibility list.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
