AN ACT
|
|
|
relating to the Hopkins County Hospital District. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 1043, Special District |
|
|
Local Laws Code, is amended by adding Section 1043.0535 to read as |
|
|
follows: |
|
|
Sec. 1043.0535. GROUNDS FOR REMOVAL. (a) It is a ground |
|
|
for removal from the board that a director is absent from at least |
|
|
four regularly scheduled board meetings that the director is |
|
|
eligible to attend in any 12-month period without an excuse |
|
|
approved by a majority vote of the board. |
|
|
(b) The validity of an action of the board is not affected by |
|
|
the fact that the action is taken when a ground for removal of a |
|
|
director exists. |
|
|
(c) A director may be removed for a ground provided by this |
|
|
section using the procedures provided by Subchapter B, Chapter 87, |
|
|
Local Government Code, for removing a county official. |
|
|
SECTION 2. Section 1043.155(a), Special District Local Laws |
|
|
Code, is amended to read as follows: |
|
|
(a) The board by resolution shall designate a bank or banks |
|
|
in Hopkins County as the district's depository or treasurer. A |
|
|
designated bank serves for three [two] years and until a successor |
|
|
is designated. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2011. |
