A BILL TO BE ENTITLED
 
AN ACT
  relating to the responsibilities of the Department of Family and
  Protective Services as trustee of the Parrie Haynes Trust.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter C, Chapter 40, Human Resources Code,
  is amended by adding Section 40.074 to read as follows:
         Sec. 40.074.  PARRIE HAYNES TRUST. (a) In this section,
  "Parrie Haynes Trust" means the trust created by Parrie Haynes's
  will in 1957 that transferred the residuary estate to the State of
  Texas for the use and benefit of orphan children in the state.
         (b)  The department shall serve as trustee for the Parrie
  Haynes Trust and shall:
               (1)  administer the Parrie Haynes Trust, including all
  trust property and investments, for the benefit of children in the
  conservatorship of the state; and
               (2)  prepare and publish annually a complete and
  detailed written statement of accounts for the Parrie Haynes Trust
  for the preceding fiscal year that includes the items described by
  Section 113.152, Property Code.
         (c)  The department may lease or sell any property of the
  Parrie Haynes Trust, including the Parrie Haynes Ranch, and use the
  proceeds from the lease or sale for the benefit of the trust
  beneficiaries. The General Land Office shall negotiate and close a
  transaction involving real property under this subsection on behalf
  of the department using procedures under Section 31.158(c), Natural
  Resources Code.
         SECTION 2.  Section 17, Chapter 952 (H.B. 3391), Acts of the
  81st Legislature, Regular Session, 2009, is repealed.
         SECTION 3.  On September 1, 2011:
               (1)  all functions and activities performed by the
  Texas Youth Commission that relate to the Parrie Haynes Trust are
  transferred to the Department of Family and Protective Services;
  and
               (2)  all property, including records, in the custody of
  the Texas Youth Commission related to the Parrie Haynes Trust
  becomes the property of the Department of Family and Protective
  Services and is transferred to the department in accordance with
  the plan created under Section 4 of this Act.
         SECTION 4.  The Texas Youth Commission and the Department of
  Family and Protective Services shall establish a transition plan
  for the transfer described in Section 3 of this Act. The plan must
  include:
               (1)  a timetable for any necessary or advisable
  movement of the physical location of property; and
               (2)  an inventory of records and other property
  required to be transferred.
         SECTION 5.  This Act takes effect September 1, 2011.
