Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Veteran Affairs & Military Installations was held on Wednesday, April 22, 2009, in the Betty King Committee Room at Austin, Texas.

The chair called the meeting to order at 2:45 p.m.  The following business was transacted: 

 

The chair recognized James E. Nier, Executive Director of the Texas Veterans Commission to lead the Pledge of Allegiance.

 

The chair laid out SB 2256 and recognized Senator Davis, in the absence of the author, to explain the bill. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that public testimony be closed; without objection, it was so ordered. 

 

Senator Van de Putte sent up Committee Amendment 1 for SB 2256.

 

Senator Van de Putte moved that SB 2256 be left pending; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 2439 and recognized the author, Senator Uresti, to explain the bill.

Senator Van de Putte requested unanimous consent to roll the adopted amendment into the committee substitute; without objection, it was so ordered.  Senator Van de Putte then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Van de Putte moved that SB 1538 do not pass but that CSSB 1538 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent.

Senator Van de Putte moved adoption of the committee substitute for SB 2223; without objection, it was so ordered. 

 

Senator Van de Putte moved that SB 2223 do not pass but that CSSB 2223 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 1 nay, 0 present not voting, and 0 absent. 

 

Senator Van de Putte moved adoption of the committee substitute for SB 2439; without objection, it was so ordered. 

 

Senator Van de Putte moved adoption of Committee Amendment 1; without objection, the amendment was adopted.

At 3:28 p.m. Senator Van de Putte resumed the chair. 

 

Senator Shapleigh sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

 

Senator Shapleigh moved that SB 2256, as amended, be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

At 3:29 p.m. Senator Van de Putte moved that the Committee stand at ease.

 

At 3:34 p.m. the chair called the committee back to order.

 

Senator Estes submitted a motion of writing to be shown voting aye on the following bills: SB 1538, SB 1648, SB 2222, SB 2223, SB 2256, SB 2439.

 

Senator Huffman submitted a motion of writing to be shown voting aye on the following bills: SB 1538, SB 1648, and SB 2256; and nay on the following bills: SB 2222, SB 2223, and SB 2439.
