Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Health & Human Services was held on Thursday, May 14, 2009, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 9:02 a.m.  The following was transacted: 

 

The chair laid out HB 461 and recognized the Senate sponsor, Senator Huffman, to explain the bill. 

 

Senator Huffman sent up a committee substitute; the chair recognized Senator Huffman to explain the difference between the committee substitute and the house bill as engrossed.  

 

Senator Nelson moved that HB 461 be left pending; without objection, it was so ordered. 

 

As a matter of pending business, the chair brought up HB 748.

 

Senator Huffman sent up a committee substitute; the chair recognized Senator Duncan to explain the difference between the committee substitute and the house bill as engrossed.  

 

Senator Nelson moved that HB 748 be left pending; without objection, it was so ordered. 

 

As a matter of pending business, the chair brought up HB 461.

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

At 9:35 a.m. a quorum was established.

 

Senator Deuell moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Huffman moved that HB 461 do not pass but that CSHB 461 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent. 

 

Senator Nelson resumed the chair. 

 

As a matter of pending business, the chair brought up HB 748.

 

Senator Nelson moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Patrick moved that HB 748 do not pass but that CSHB 748 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 3 absent. 

 

As a matter of pending business, the chair brought up SB 943.

 

Senator Nelson moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Nelson moved that SB 943 be left pending; without objection, it was so ordered. 

 

Senator Deuell assumed the chair.
