Pursuant to suspension of Senate Rules 11.10 and 11.18, a public hearing of the Senate Committee on Criminal Justice was held on Thursday, April 30, 2009, at Senator Whitmire's Desk on the Senate Floor in Austin, Texas.

The chair called the meeting to order at 5:45 p.m.  There being a quorum present, the following business was transacted: 

 

Senator Ellis requested unanimous consent to be shown voting with Senator Whitmire on all bills.

 

As a matter of pending business, the chair laid out SB 1176.  Senator Patrick moved adoption of the committee substitute that was explained during the public hearing on April 28, 2009; without objection, it was so ordered.  Senator Patrick moved that SB 1176 do not pass but that CSSB 1176 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 1844.  Senator Hinojosa moved that SB 1844 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 2037.  Senator Hinojosa moved adoption of the committee substitute that was explained during the public hearing on April 28, 2009; without objection, it was so ordered.  Senator Hinojosa moved that SB 2037 do not pass but that CSSB 2037 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 2075.  Senator Hinojosa sent up a committee substitute and moved adoption; without objection, it was so ordered.  Senator Hinojosa moved that SB 2075 do not pass but that CSSB 2075 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 1 nay, 0 present not voting, and 2 absent. 

 

As a matter of pending business, the chair laid out SB 2438.  Senator Hinojosa moved that SB 2438 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out HB 1282.  Senator Hinojosa moved that HB 1282 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 1454.  Senator Hinojosa moved adoption of the committee substitute that was explained during the public hearing on April 28, 2009; without objection, it was so ordered.  Senator Hinojosa moved adoption of Committee Amendment 1 that was explained during the public hearing on April 28, 2009; without objection, the amendment was adopted.  Senator Whitmire requested unanimous consent to incorporate the amendment into the committee substitute; without objection, it was so ordered.  Senator Whitmire then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Hinojosa moved that SB 1454 do not pass but that CSSB 1454 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Patrick moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.      

 

As a matter of pending business, the chair laid out SB 1707.  Senator Hinojosa moved that SB 1707 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Hegar submitted a motion in writing to request unanimous consent to be shown voting aye on SB 1176, SB 1454, SB 1707, SB 1844, SB 2037, SB 2075, SB 2438, and HB 1282.

 

There being no further business, at 5:52 p.m. Senator Whitmire moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
