Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on State Affairs was held on Wednesday, April 8, 2009, in the Senate Chamber.

The chair called the meeting to order at 10:02 a.m.  The following business was transacted: 

 

The chair laid out SB 1732 and recognized the author, Senator West, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Duncan moved that SB 1732 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1228 and recognized Senator Van de Putte, in the absence of the author, to explain the bill.  Witnesses registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Duncan moved that SB 1228 be left pending; without objection, it was so ordered.

The chair referred the following bills to a Subcommittee for further consideration: SB 26 by Zaffirini, SB 64 by Zaffirini, SB 1345 by Watson, SB 1348 by Van de Putte, SB 1366 by Ellis, SB 2076 by Uresti and SB 2205 by Van de Putte.  The chair appointed Senator Fraser as chair of the subcommittee and Senators Deuell, Jackson, and Van de Putte as members of the subcommittee. 

 

The chair moved that the committee stand at ease until 12:30 to await arrival of a quorum. 

 

At 12:37 p.m. the committee reconvened. 

 

The chair laid out as a matter of pending business SB 378.  Senator Van de Putte sent up a committee substitute.  Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered.  Senator Duncan moved that SB 378 do not pass but that CSSB 378 be reported back to the full Senate committee on  with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.
