Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on State Affairs was held on Monday, March 30, 2009, in the Senate Chamber.

The chair called the meeting to order at 10:15 a.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out SB 66 and recognized the author, Senator Nelson, to explain the bill.  Senator Harris sent up a committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Harris moved adoption of the committee substitute; without objection, it was so ordered.  Senator Harris moved that SB 66 do not pass but that CSSB 66 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.          

 

The chair laid out SB 95 and recognized the author, Senator Van de Putte, to explain the bill. 

Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed.  Senator Van de Putte moved adoption of the committee substitute; without objection, it was so ordered. Witnesses registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Van de Putte moved that SB 95 do not pass but that CSSB 95 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Van de Putte moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out SB 1403 and recognized Senator Harris, in the absence of the author, to explain the bill.  Senator Harris sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Witnesses registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Harris requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Duncan then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Harris moved that SB 1403 do not pass but that CSSB 1403 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

The chair suspended consideration of SB 961.  Upon arrival of a quorum, the chair laid out as a matter of pending business SB 695.  The chair moved that the bill be pulled down and left pending; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 872.  Senator Carona sent up a committee substitute; the chair recognized Senator Nelson to explain the difference between the committee substitute and the senate bill as filed.  Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered.  Senator Lucio, Jr. moved that SB 872 do not pass but that CSSB 872 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Deuell moved that all committee amendments to SB 18 and SB 533 be filed with the office of the Senate Committee on State Affairs no later than 6:00 PM on Thursday, April 2, 2009.  Any amendments received after the deadline may not be considered by the Committee; without objection, it was so ordered.

 

At the request of Senator Fraser, Senator Lucio, Jr. moved to reconsider the vote by which SB 963 was referred to the local and uncontested calendar; without objection it was so ordered.    

 

Senator Ellis moved unanimous consent to be shown voting aye on SB 95, SB 1403 and SB 1771; without objection, it was so ordered.

 

The chair laid out SB 18 and recognized the author, Senator Estes, to explain the bill.

The chair laid out SB 533 and recognized the author, Senator Duncan, to explain the bill. 

 

Senator Harris sent up Committee Amendment 1 to SB 18 and was recognized to explain the amendment.

The chair opened public testimony.  Witnesses testifying and registering on SB 18 and SB 533 are shown on the attached list.  Senator Deuell moved that SB 18 and SB 533 be left pending; without objection, it was so ordered. 

 

Senator Deuell moved that the committee stand at ease until after adjournment of the Senate; without objection, it was so ordered. 

 

At 3:50 p.m. the committee reconvened. 

 

Senator Deuell, the acting chair, moved that public testimony on SB 18 and SB 533 continue.

The chair temporarily suspended public testimony to lay out as a matter of pending business SB 963.  Senator Fraser moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Public testimony on SB 18 and SB 533 resumed.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Duncan moved that SB 18 and SB 533 be left pending; without objection, it was so ordered.
