Pursuant to a notice posted in accordance with Senate Rule 11.18, the Senate Committee on State Affairs held a public hearing on Monday, March 9, 2009, in the Senate Chamber.

The chair called the meeting to order at 10:04 a.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out SB 317 and recognized the author, Senator Wentworth, to explain the bill.  Witnesses who testified and registered on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Duncan moved that SB 317 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 92 and recognized the author, Senator Van de Putte, to explain the bill.  

 

Senator Van de Putte sent up a committee substitute.  The chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed. 

Witnesses who testified and registered on the bill are shown on the attached list. 

 

Senator Van de Putte sent up Committee Amendment 1 and was recognized to explain the amendment.  The Chair withdrew Committee Amendment 1.  Without objections, it was so ordered

 

Senator Van de Putte sent up Committee Amendment 2 and moved adoption; without objection, the amendment was adopted.   Senator Van de Putte sent up committee substitute to SB 92 as amended.  Duncan moved adoption.  Without objection it was so ordered

 

Senator Van de Putte requested unanimous consent to roll the adopted amendment into the committee substitute; without objection, it was so ordered.  Senator Duncan moved that SB 92 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 627 and recognized the author, Senator Carona, to explain the bill.  Senator Carona sent up a committee substitute.  The chair recognized Senator Carona to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered.   The chair moved that the public testimony be closed; without objection, it was so ordered.   Senator Duncan moved that SB 627 be left pending to await a quorum; without objection, it was so ordered. 

 

Senator Deuell assumed the chair. 

 

The chair laid out SB 555 and recognized the author, Senator Duncan, to explain the bill.  Senator Duncan sent up a committee substitute.  The chair recognized Senator Duncan to explain the difference between the committee substitute and the senate bill as filed.  Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Deuell moved that SB 555 be left pending to await a quorum; without objection, it was so ordered. 

 

At 11:35 a.m. Senator Duncan moved that the committee stand at ease until 11:45 a.m; without objection, it was so ordered.    

 

At 12:50 p.m. the chair reconvened the meeting.

 

The chair laid out as a matter of pending business SB 39.  Senator Ellis moved that SB 39 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.

 

The chair laid out as a matter of pending business SB 309 and recognized the author, Senator Jackson, to explain the bill.  Senator Jackson sent up a committee substitute; the chair recognized Senator Jackson to explain the difference between the committee substitute and the senate bill as filed.  Senator Jackson moved adoption of the committee substitute; without objection, it was so ordered.

 

Senator Jackson moved that SB 309 do not pass but that CSSB 309 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Lucio, Jr. and Senator Harris requested unanimous consent to be shown voting aye on SB 39.  Without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 315.  Senator Carona moved that SB 315 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 3 nays, 0 present not voting, and 0 absent.

 

The chair laid out as a matter of pending business SB 687.  Senator Carona moved that SB 687 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Jackson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Deuell assumed the chair.  As a matter of pending business, the chair laid out SB 555.

 

Senator Duncan moved that SB 555 do not pass but that CSSB 555 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 1 nay, 0 present not voting, and 0 absent. 

 

Senator Duncan resumed the chair. 

 

The chair laid out as a matter of pending business SB 627.  Senator Carona moved that SB 627 do not pass but that CSSB 627 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Carona moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

There being no further business, at 1:05 p.m. Senator Duncan moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
