Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Government Organization was held on Wednesday, May 20, 2009, in the Extension Auditorium, El.004.

The chair called the meeting to order at 3:30 p.m.  The following business was transacted: 

 

The chair laid out HCR 182 and recognized Johanna Thomas, in the absence of the Senate sponsor, to explain the bill. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

At 3:32 p.m. the chair moved that the committee stand at ease until 4:00 p.m.; without objection, it was so ordered.

 

At 4:17 p.m. Senator Ellis reconvened the committee. 

 

Senator Hegar moved that HCR 182 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 3689 and recognized Senator Hegar, in the absence of the Senate sponsor, to explain the bill. Senator Hegar sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the house bill as engrossed. Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered. This bill was left pending. Witnesses testifying and registering on the bill are shown on the attached list.

 

Senator Hegar sent up Committee Amendment 1 relating to the Juvenile Probation Board. Senator Hegar then withdrew Committee Amendment 1. 

 

At 4:19 p.m. Senator Whitmire assumed the chair.

 

At 4:24 p.m. Senator Ellis resumed the chair.

 

At 4:28 p.m. Senator Whitmire assumed the chair.

 

At 4:40 p.m. Senator Ellis resumed the chair.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

The chair laid out HB 1959 and recognized the Senate sponsor, Senator Hegar, to explain the bill.  Senator Hegar sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the house bill as engrossed. Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Ellis sent up Committee Amendment 1 relating to the State Board of Education. The amendment was withdrawn. Senator Hegar moved that HB 1959 do not pass but that CSHB 1959 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Hegar moved that public testimony be re-opened for HB 3689. Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

The chair laid out HB 2730 and recognized Senator Hegar, in the absence of the Senate sponsor, to explain the bill.

Senator Hegar sent up a committee substitute; the chair recognized Senator Deuell to explain the difference between the committee substitute and the house bill as engrossed.  Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered. 

 

At 5:25 p.m. Senator Ellis resumed the chair.

 

Witnesses testifying and registering on the bill are shown on the attached list. The chair moved that the public testimony be closed; without objection, it was so ordered. Senator Ellis sent up Committee Amendment 1 relating to Racial Profiling. Senator Ellis then withdrew the amendment. Senator Hegar moved that HB 3389 do not pass but that CSHB 3389 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent.  

 

The chair laid out HB 2097 and recognized the Senate sponsor, Senator Hegar, to explain the bill. This bill was left pending.

 

There being no further business, at 5:36 p.m. Senator Ellis moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
