Pursuant to suspension of Senate Rule 11.18, a public hearing of the Senate Committee on Government Organization was held on Tuesday, May 12, 2009, at Senator Ellis's Desk.

The chair called the meeting to order at 3:37 p.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out as a matter of pending business SB 266. Senator Hegar sent up a committee substitute and was recognized to explain the difference between the committee substitute and the senate bill as filed at a previous hearing. Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered. Senator Hegar sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. Senator Hegar requested unanimous consent to roll the amendment into the committee substitute; without objection, it was so ordered. Senator Hegar then moved that the new committee substitute be adopted; without objection, it was so ordered. Senator Hegar moved that SB 266 do not pass but that CSSB 266 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business HB 1705. Senator Lucio, Jr. moved that HB 1705 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business HB 2004. Senator Lucio, Jr. moved that HB 2004 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business HB 2447. Senator Lucio, Jr. sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

Senator Hegar sent up Committee Amendment 2 and moved adoption; without objection, the amendment was adopted. Senator Hegar requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Hegar then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Hegar moved that HB 2447 do not pass but that CSHB 2447 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Hegar moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Lucio, Jr. moved that HB 3756 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Lucio, Jr. moved that HCR 18 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent. Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business HB 3391. Senator Hegar sent up a committee substitute; the chair recognized Senator Hegar to explain the difference between the committee substitute and the house bill as engrossed. Senator Hegar moved adoption of the committee substitute; without objection, it was so ordered.  Senator Hegar moved that HB 3391 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 6 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Nelson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

There being no further business, at 3:47 p.m. Senator Ellis moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
