Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Thursday, May 14, 2009, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 2:30 p.m.  The following business was transacted: 

 

The chair laid out HB 2628 and recognized the Senate sponsor, Senator Watson, to explain the bill.  There being no public testimony, the chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that HB 2628 be left pending to await a quorum; without objection, it was so ordered. 

 

The chair laid out HB 1257 and recognized Senator Deuell, in the absence of the Senate sponsor, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. 

The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that HB 1257 be left pending to await a quorum; without objection, it was so ordered. 

 

Senator Seliger assumed the chair. 

 

The chair laid out HB 4661 and recognized the Senate sponsor, Senator Ogden, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Seliger moved that HB 4661 be left pending to await a quorum; without objection, it was so ordered. 

 

Senator Ogden resumed the chair. 

 

The chair laid out HB 986 and recognized the Senate sponsor, Senator Hinojosa, to explain the bill.  Senator Hinojosa sent up Committee Amendment 1.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that HB 986 be left pending to await a quorum; without objection, it was so ordered. 

 

The chair laid out HB 2628, which had been left pending earlier in the hearing, and re-opened public testimony.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that HB 2628 be left pending to await a quorum; without objection, it was so ordered. 

 

At 2:41 p.m. Senator Ogden moved that the Committee stand at ease awaiting the arrival of a quorum; without objection, it was so ordered.

 

Senator Ogden reconvened the Committee at 2:50 p.m.

 

The roll was called, and a quorum was established.

 

The chair laid out as a matter of pending business HB 77.  Senator Deuell moved that HB 77 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator Nelson requested unanimous consent to be showing voting aye; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business HB 422, and a committee substitute adopted at a previous hearing.  Senator Lucio, Jr. moved that HB 422 do not pass but that CSHB 422 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator Nelson requested unanimous consent to be showing voting aye; without objection, it was so ordered.  Senator Lucio, Jr. moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Hinojosa assumed the chair. 

 

The chair laid out as a matter of pending business HB 2729.  Senator Ogden moved that HB 2729 be reported favorably to the Senate with the recommendation that it do pass and be printed.

The chair laid out HB 986 and Committee Amendment 1, which had been left pending earlier in the hearing.  Senator Hinojosa moved adoption of Committee Amendment 1; without objection, it was so ordered.  Senator Hinojosa requested unanimous consent to roll the amendment into a committee substitute; without objection, it was so ordered.  Senator Hinojosa then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Hinojosa moved that HB 986 do not pass but that CSHB 986 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator Hinojosa moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 1257, which had been left pending earlier in the hearing.  Senator Deuell moved that HB 1257 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator Averitt moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 2628, which had been left pending earlier in the hearing.  Senator Whitmire moved that HB 2628 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator Whitmire moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

The chair laid out HB 4661, which had been left pending earlier in the hearing.  Senator Ogden moved that HB 4661 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion failed by a record vote of 3 ayes, 7 nays, 0 present not voting, and 5 absent.  Senator Ogden moved to reconsider the vote; without objection, it was so ordered. Senator Ogden moved that HB 4661 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator West moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Ogden resumed the chair.
