Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Monday, May 11, 2009, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 4:31 p.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out HB 77 and recognized the Senate sponsor, Senator Nichols, to explain the bill. 

Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that HB 77 be left pending; without objection, it was so ordered. 

 

The chair laid out HB 422 and recognized Senator Seliger, in the absence of the Senate sponsor, to explain the bill.  Senator Seliger sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the house bill as engrossed.  Senator Seliger moved adoption of the committee substitute; without objection, it was so ordered.  There being no public testimony, the chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that HB 422 be left pending; without objection, it was so ordered. 

 

The chair laid out HB 1407 and recognized the Senate sponsor, Senator Davis, to explain the bill. 

Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that HB 1407 be left pending; without objection, it was so ordered. 

 

The chair laid out HB 2083 and recognized Senator Hinojosa, in the absence of the Senate sponsor, to explain the bill.  Senator Ogden moved that HB 2083 be left pending awaiting public testimony; without objection, it was so ordered.

 

The chair laid out SB 1315 and recognized Senator Williams, in the absence of the author, to explain the bill.  Senator Williams sent up a committee substitute; the chair recognized Senator Williams to explain the difference between the committee substitute and the senate bill as filed.  Senator Williams moved adoption of the committee substitute; without objection, it was so ordered.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 1315 be left pending; without objection, it was so ordered. 

 

The chair laid out HB 1407, which had been left pending earlier in the hearing.  Senator Zaffirini moved that HB 1407 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 6 absent.  Senator West moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business HB 406.  Senator Williams moved that HB 406 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 6 absent. 

 

The chair laid out as a matter of pending business HB 2591, and a committee substitute adopted at a previous hearing.  Senator Seliger moved that HB 2591 do not pass but that CSHB 2591 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 1 present not voting, and 6 absent. 

 

The chair laid out HB 2083, which had been left pending awaiting public testimony.  Witnesses testifying and registering on the bill are shown on the attached list. 

 

Senator Hinojosa assumed the chair. 

 

Testimony continued.

 

Senator Zaffirini assumed the chair. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Zaffirini moved that HB 2083 be left pending; without objection, it was so ordered. 

 

There was no action taken for the following bill(s): HB 2729 and SB 2301.

 

There being no further business, at 5:12 p.m. Senator Zaffirini moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
