Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Tuesday, April 28, 2009, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 3:31 p.m.  There being a quorum present, the following business was transacted: 

 

Senator Hinojosa assumed the chair. 

 

The chair laid out as a matter of pending business SB 505, and a committee substitute sent up at a previous hearing.  Senator Ogden moved to pull down the committee substitute sent up at a previous hearing; without objection, it was so ordered.  Senator Ogden sent up a new committee substitute; the chair recognized Senator Ogden to explain the difference between the committee substitute and the senate bill as filed.  Senator Ogden moved adoption of the committee substitute; without objection, it was so ordered.  Senator Ogden moved that SB 505 do not pass but that CSSB 505 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion finally carried with a record vote of 11 ayes, 1 nay, 0 present not voting, and 3 absent.  Senator Lucio and Senator Shapiro requested unanimous consent to be shown voting aye; without objection, it was so ordered.

 

Senator Ogden resumed the chair. 

 

The chair laid out as a matter of pending business SB 841, and a committee substitute sent up at a previous hearing.  Senator Averitt moved to pull down the committee substitute sent up at a previous hearing; without objection, it was so ordered.  Senator Averitt sent up a new committee substitute; the chair recognized Senator Averitt to explain the difference between the committee substitute and the senate bill as filed.  Senator Averitt moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Ogden moved that the following votes remain open until 5:00 p.m.; without objection, it was so ordered. 

 

Senator Averitt moved that SB 841 do not pass but that CSSB 841 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion finally carried with a record vote of 12 ayes, 2 nays, 0 present not voting, and 1 absent.   

 

The chair laid out as a matter of pending business SB 1497, and a committee substitute adopted at a previous hearing.  Senator Hinojosa moved that SB 1497 do not pass but that CSSB 1497 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion finally carried with a record vote of 14 ayes, 0 nay, 0 present not voting, and 1 absent.

The chair laid out as a matter of pending business SB 2084, and a committee substitute adopted at a previous hearing.  Senator Ogden moved that SB 2084 do not pass but that CSSB 2084 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion finally carried with a record vote of 9 ayes, 5 nays, 0 present not voting, and 1 absent. 

 

Senator Ogden resumed the chair. 

 

The chair laid out as a matter of pending business SB 2240, and a committee substitute sent up at a previous hearing.  Senator Zaffirini moved to pull down the committee substitute sent up at a previous hearing; without objection, it was so ordered.  Senator Zaffirini sent up a new committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  Senator Zaffirini moved adoption of the committee substitute; without objection, it was so ordered.  Senator Zaffirini moved that SB 2240 do not pass but that CSSB 2240 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion finally carried with a record vote of 13 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Zaffirini moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 2407. 

 

Senator Hinojosa assumed the chair. 

 

Senator Zaffirini sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  Senator Ogden moved adoption of the committee substitute; without objection, it was so ordered.  Senator Ogden sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Senator Nelson sent up an amendment to Committee Amendment 1 and moved adoption. The motion failed with a record vote of 3 ayes, 9 nays, 0 present not voting, and 3 absent.  Senator Hinojosa requested unanimous consent to incorporate the amendment into the committee substitute; without objection, it was so ordered.  Senator Hinojosa then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Hinojosa moved that SB 2407 be left pending; without objection, it was so ordered. 

 

Senator Ogden resumed the chair. 

 

There being no further business, at 4:52 p.m. Senator Ogden moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
