Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Wednesday, April 15, 2009, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 8:38 a.m.  There being a quorum present, the following business was transacted: 

 

The roll was called, and a quorum was confirmed.

 

The chair laid out as a matter of pending business SB 263.  Senator Ogden moved to pull down a committee substitute sent up at a previous hearing; without objection, it was so ordered.  Senator Lucio, Jr. sent up a new committee substitute; the chair recognized Senator Carona to explain the difference between the committee substitute and the senate bill as filed.  Senator Lucio, Jr. moved adoption of the committee substitute; without objection, it was so ordered.  Senator Lucio moved that SB 263 do not pass but that CSSB 263 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator Shapiro and Senator Williams requested unanimous consent to be shown voting aye; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 471, and a committee substitute sent up and adopted at a previous hearing.  Senator Hinojosa moved that SB 471 do not pass but that CSSB 471 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator Williams requested unanimous consent to be shown voting aye; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1350.  Senator Lucio, Jr. sent up a committee substitute; the chair recognized Senator Carona to explain the difference between the committee substitute and the senate bill as filed.  Senator Lucio, Jr. moved adoption of the committee substitute; without objection, it was so ordered.    Senator Lucio, Jr. moved that SB 1350 do not pass but that CSSB 1350 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 10 ayes, 0 nay, 0 present not voting, and 5 absent.  Senator Williams requested unanimous consent to be shown voting aye; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 1359.  Senator Seliger moved that SB 1359 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 6 absent.  Senator Williams requested unanimous consent to be shown voting aye; without objection, it was so ordered.  Senator Seliger moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 2146.  Senator Duncan sent up a committee substitute; the chair recognized Senator Duncan to explain the difference between the committee substitute and the senate bill as filed.  Senator Duncan moved adoption of the committee substitute; without objection, it was so ordered.  Senator Duncan moved that SB 2146 do not pass but that CSSB 2146 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 6 absent.  Senator Williams requested unanimous consent to be shown voting aye; without objection, it was so ordered.  Senator Duncan moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senator Hinojosa assumed the chair. 

 

The chair laid out as a matter of pending business SB 1024, and a committee substitute sent up at a previous hearing.  Senator Ogden moved adoption of the committee substitute; without objection, it was so ordered.  Senator Hinojosa moved that SB 1024 be left pending; without objection, it was so ordered. 

 

Senator Ogden resumed the chair. 

 

There being no further business, at 9:06 a.m. Senator Ogden moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
