Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Monday, April 6, 2009, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 9:03 a.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out as a matter of pending business SB 20, SB 700, SB 771, and SB 1497, of which public testimony had been left open at a previous hearing.  Witnesses testifying and registering on the bills are shown on the attached list.  The chair moved that the public testimony on SB 20, SB 700, SB 771, and SB 1497 be closed; without objection, it was so ordered.  Senator Williams moved adoption of a committee substitute sent up on SB 700 at a previous hearing; without objection, it was so ordered.  Senator Williams moved adoption of a committee substitute sent up on SB 771 at a previous hearing; without objection, it was so ordered.  Senator Williams moved adoption of a committee substitute sent up on SB 1497 at a previous hearing; without objection, it was so ordered.  Senator Ogden moved that SB 20, SB 700, SB 771, and SB 1497 be left pending; without objection, it was so ordered. 

 

 

 

The chair laid out SB 679 and recognized the author, Senator Lucio, Jr., to explain the bill. 

Senator Lucio, Jr. sent up a committee substitute; the chair recognized Senator Lucio, Jr. to explain the difference between the committee substitute and the senate bill as filed.  Senator Lucio, Jr. moved adoption of the committee substitute; without objection, it was so ordered. 

Witnesses testifying and registering on the bill are shown on the attached list.  Senator Ogden moved that SB 679 be left pending awaiting further public testimony; without objection, it was so ordered.

 

The chair laid out SB 2146 and recognized the author, Senator Duncan, to explain the bill.  Senator Ogden moved that SB 2146 be left pending awaiting public testimony; without objection, it was so ordered.

 

The chair laid out SB 1355 and recognized the author, Senator Lucio, Jr., to explain the bill. 

Witnesses testifying and registering on the bill are shown on the attached list.  Senator Ogden moved that SB 1355 be left pending awaiting further public testimony; without objection, it was so ordered.

 

The chair laid out SB 2045 and recognized the author, Senator Williams, to explain the bill. 

Senator Williams sent up a committee substitute; the chair recognized Senator Williams to explain the difference between the committee substitute and the senate bill as filed.  Senator Ogden moved that SB 2045 be left pending awaiting public testimony; without objection, it was so ordered.

 

The chair laid out SJR 48 and recognized the author, Senator Williams, to explain the bill.  Senator Ogden moved that SJR 48 be left pending awaiting public testimony; without objection, it was so ordered.

 

The chair laid out SB 679, which had been left pending awaiting further public testimony earlier in the hearing.  Witnesses testifying and registering on the bill are shown on the attached list. 

The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 679 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 966 and recognized Senator West, in the absence of the author, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 966 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 679, which had been left pending earlier in the hearing, and re-opened public testimony.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 679 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1355, which had been left pending awaiting further public testimony earlier in the hearing.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 1355 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1782 and recognized Senator Averitt, in the absence of the author, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

Senator Ogden moved that SB 1782 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 2045, which had been left pending awaiting public testimony earlier in the hearing.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 2045 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 2146, which had been left pending awaiting public testimony earlier in the hearing.  There being no public testimony, the chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SB 2146 be left pending; without objection, it was so ordered. 

 

The chair laid out SJR 48, which had been left pending awaiting public testimony earlier in the hearing.  There being no public testimony, the chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Ogden moved that SJR 48 be left pending; without objection, it was so ordered. 

 

There was no action taken for the following bill(s): SB 2084.

 

There being no further business, at 10:08 a.m. Senator Ogden moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
