Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Monday, March 30, 2009, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 9:09 a.m.  There being a quorum present, the following business was transacted: 

 

The roll was called, and a quorum was confirmed.

 

The chair laid out SB 1 as pending business.  Witnesses testifying and registering on the bill are shown on the attached list.  Senator Ogden sent up a committee substitute. 

 

Senator Ogden laid out a technical correction to add $7 million in General Revenue and TANF, and a commensurate amount of federal funds, to the foster care payment strategy in Article II, relating to reimbursement rate increases for foster parents contracting through placing agencies.

 

Senator Ogden moved to adopt the technical correction to add $7 million in General Revenue and TANF, and a commensurate amount of federal funds, to the foster care payment strategy in Article II, relating to reimbursement rate increases for foster parents contracting through placing agencies; without objection, it was so ordered.

 

Senator Ogden requested unanimous consent to incorporate the technical correction into the committee substitute; without objection, it was so ordered.

Senator Ogden then moved that the new committee substitute be adopted; without objection, it was so ordered.  Senator Ogden moved that SB 1 do not pass but that CSSB 1 be reported back to the Senate with the recommendation that it do pass and not be printed.  The motion carried with a record vote of 14 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Ogden moved that the vote on CSSB 1 remain open; without objection, it was so ordered.

The chair laid out as a matter of pending business SB 562.  Senator Hinojosa moved that SB 562 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 14 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Ogden moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

The chair laid out as a matter of pending business SB 792, and the previously adopted committee substitute for SB 792.  Senator Nelson moved that SB 792 do not pass but that CSSB 792 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 14 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Nelson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Duncan moved that SJR 35 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 13 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Shapiro requested unanimous consent to be shown voting aye; without objection, it was so ordered.  The motion finally carried with a record vote of 14 ayes, 0 nay, 0 present not voting, and 1 absent.

The Committee heard testimony regarding Major State Investment Funds.  Witnesses testifying and registering on the subject are shown on the attached list. 

 

The vote being open on CSSB 1, Senator Averitt requested to be shown voting aye; without objection, it was so ordered.  The motion finally carried with a record vote of 15 ayes, 0 nay, 0 present not voting, and 0 absent.

 

Testimony resumed regarding Major State Investment Funds.  Witnesses testifying and registering on the subject are shown on the attached list.
