Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Friday, March 20, 2009, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 9:17 a.m. 

 

Senator Ogden moved that the Committee stand at ease until 9:30 a.m.; without objection, it was so ordered.

 

Senator Ogden reconvened the Committee at 9:32 a.m.  There being a quorum present, the following business was transacted:

 

The chair laid out SB 1 as pending business.  Witnesses testifying and registering on the bill are shown on the attached list.

 

Senator Ogden laid out a rider regarding Article IX, Funding Contingent upon the Passage of Legislation.

 

Senator Ogden moved to adopt the rider regarding Article IX, Funding Contingent upon the Passage of Legislation; without objection, it was so ordered.

 

The chair recognized Senator Hinojosa to lay out the recommendations for Article I riders, including recommendations for Article XI.

 

Senator Hinojosa moved to adopt the recommendations for Article I riders, including recommendations for Article XI; without objection, it was so ordered.

 

The chair recognized Senator Deuell to lay out the recommendations for Article II riders, including recommendations for Article XI.

 

Senator Deuell moved to adopt the recommendations for Article II riders, including recommendations for Article XI; without objection, it was so ordered.

 

The chair recognized Senator Zaffirini to lay out the recommendations for Article III riders, including recommendations for Article XI.

 

Senator Zaffirini moved to adopt the recommendations for Article III riders, including recommendations for Article XI; without objection, it was so ordered.

 

The chair recognized Senator Hinojosa to lay out the recommendations for Article IV riders, including recommendations for Article XI.

 

Senator Hinojosa moved to adopt the recommendations for Article IV riders, including recommendations for Article XI; without objection, it was so ordered.

 

The chair recognized Senator Eltife to lay out the recommendations for Article V riders, including recommendations for Article XI.

 

Senator Eltife moved to adopt the recommendations for Article V riders, including recommendations for Article XI.  There being objection, a record vote was taken.  The motion carried with a record vote of 11 ayes, 1 nay, 0 present not voting, and 3 absent.

 

The chair recognized Senator Averitt to lay out the recommendations for Article VI riders, including recommendations for Article XI.

 

Senator Averitt moved to adopt the recommendations for Article VI riders, including recommendations for Article XI; without objection, it was so ordered.

 

The chair recognized Senator Eltife to lay out the recommendations for Article VII riders.

 

Senator Elitfe moved to adopt the recommendations for Article VII riders; without objection, it was so ordered.

 

The chair recognized Senator Duncan to lay out the rider on page 39 of the Article III Not Recommended packet, relating to a Study on Directly Contracting with Medicare for Retiree Prescription Drug Coverage.

The chair recognized Senator Duncan to lay out the rider on page 41 of the Article III Not Recommended packet, relating to Proposed Funding and Rider Amendments, Contingent Appropriations for Small Business Development Centers.

 

Senator Duncan moved to adopt the rider on page 41 of the Article III Not Recommended packet, relating to Proposed Funding and Rider Amendments, Contingent Appropriations for Small Business Development Centers; without objection, it was so ordered.

 

The chair recognized Senator Zaffirini to lay out the rider on page 8 of the Article III Not Recommended packet, relating to the Texas Education Agency - Rapid Decline in Attendance. 

 

The chair recognized Senator Whitmire to lay out the rider on page 11 of the Article VII Not Recommended packet, regarding the Department of Housing and Community Affairs - Homeless Housing and Services.

 

Senator Whitmire moved that the rider on page 11 of the Article VII Not Recommended packet, regarding the Department of Housing and Community Affairs - Homeless Housing and Services, be moved to Article XI; without objection, it was so ordered.

 

The chair recognized Senator Whitmire to lay out the rider on page 59 of the Article III Not Recommended packet, regarding Texas Southern University - Mickey Leland and Barbara Jordan Papers. 

 

Senator Ogden moved that SB 1 be left pending; without objection, it was so ordered. 

 

There being no further business, at 10:08 a.m. Senator Ogden moved that the Committee stand recessed until 9:00 a.m., March 23, 2009.  Without objection, it was so ordered.
