Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Finance was held on Thursday, March 19, 2009, in the Capitol Extension, Room E1.036, at Austin, Texas.

The chair called the meeting to order at 9:01 a.m.  There being a quorum present, the following business was transacted: 

 

The chair laid out SB 1 as pending business.  Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair recognized Senator West to lay out the workgroup recommendations for Article III.

 

Senator West moved to adopt the workgroup recommendations for Article III, Higher Education Coordinating Board; without objection, it was so ordered.

 

Senator West moved to adopt the workgroup recommendations for Article III, Available University Fund and Higher Education Fund; without objection, it was so ordered.

 

Senator West moved to adopt the workgroup recommendations for Article III, Health Related Institutions; without objection, it was so ordered.

 

Senator West moved to adopt the workgroup recommendations for Article III, Texas A&M University System Agencies; without objection, it was so ordered.

 

Senator West moved to adopt the workgroup recommendations for Article III, Higher Education Special Provisions; without objection, it was so ordered.

 

Senator Ogden moved that the hold harmless funding for Texas Woman's University be reduced from approximately $15 million to $10 million; without objection, it was so ordered.

 

Senator West moved to adopt the amended workgroup recommendations for Article III, General Academic Institutions, System Offices, Lamar State Colleges, and Texas State Technical Colleges; without objection, it was so ordered.

 

Senator Ogden moved to reconsider the vote by which the Committee had previously adopted the workgroup recommendations for Article III, General Academic Institutions, System Offices, Lamar State Colleges, and Texas State Technical Colleges; without objection, it was so ordered.

 

Senator Ogden moved to adopt the workgroup recommendations for Item 69, relating to Funding for Texas A&M University - Corpus Christi, Engineering Program.  There being objection, a record vote was taken.  The motion carried with a record vote of 12 ayes, 0 nay, 1 present not voting, and 2 absent. 

 

Senator Ogden moved to adopt the amended workgroup recommendations for Article III, General Academic Institutions, System Offices, Lamar State Colleges, and Texas State Technical Colleges; without objection, it was so ordered.

 

Senator Whitmire requested unanimous consent to be shown voting aye on any previous votes during the hearing for which he was not present, regarding Article III - Higher Education and Health Related Institutions; without objection, it was so ordered.

 

Senator Ogden moved that SB 1 be left pending; without objection, it was so ordered. 

 

At 9:55 a.m. Senator Ogden moved that the Committee stand recessed until 3:00 p.m.; without objection, it was so ordered.

 

Senator Ogden reconvened the Committee at 3:12 p.m.

Senator Ogden laid out the LBB recommendations for Article X.

 

Senator Ogden laid out the recommendations for Article IX, Exempt Salaries. 

 

Senator Hinojosa moved to adopt the recommendations for Article IX, Exempt Salaries; without objection, it was so ordered.

 

Senator Williams moved to adopt the LBB recommendations for Article X; without objection, it was so ordered.

 

The chair recognized Senator Eltife to lay out the workgroup recommendations for Article V.

 

Senator Eltife moved to adopt the workgroup recommendations for Article V, Juvenile Probation Commission; without objection, it was so ordered.

 

Senator Eltife moved to adopt the workgroup recommendations for Article V, Texas Youth Commission; without objection, it was so ordered.

 

Senator Eltife moved to adopt the workgroup recommendations on the All Remaining Items - Article V document; without objection, it was so ordered.

 

The chair recognized Senator Duncan to lay out recommendations for Article V, Correctional Managed Health Care.
