Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, April 14, 2009, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:34 a.m.  There being a quorum present, the following business was transacted: 

 

Senator Patrick moved adoption of the minutes from the previous hearings held on March 31, 2009, and April 7, 2009; without objection, it was so ordered. 

 

As a matter of pending business the chair laid out SB 282 and Senator Shapiro, in the absence of the author, explained the bill and the substitute previously sent up.  Senator Patrick moved adoption of the committee substitute; without objection, it was so ordered.  Senator Patrick moved that SB 282 do not pass but that CSSB 282 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 1 nay, 0 present not voting, and 2 absent. 

 

As a matter of pending business the chair laid out SB 867 and Senator Shapiro, in the absence of the author, explained the bill.  Senator Patrick sent up a committee substitute; the chair recognized Senator Shapiro to explain the difference between the committee substitute and the senate bill as filed.  Senator Patrick moved adoption of the committee substitute; without objection, it was so ordered.  Senator West moved that SB 867 do not pass but that CSSB 867 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 1 nay, 0 present not voting, and 2 absent.

 

As a matter of pending business the chair laid out SB 892 and Senator Shapiro, in the absence of the author, explained the bill.  Senator Patrick sent up a committee substitute; the chair recognized Senator Shapiro to explain the difference between the committee substitute and the senate bill as filed.  Senator Patrick moved adoption of the committee substitute; without objection, it was so ordered.  Senator Patrick moved that SB 892 do not pass but that CSSB 892 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator Ogden moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business the chair laid out SB 1125 and recognized the author, Senator Zaffirini, to explain the bill.  Senator West sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  Senator West moved adoption of the committee substitute; without objection, it was so ordered.  Senator Patrick moved that SB 1125 do not pass but that CSSB 1125 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 1 nay, 0 present not voting, and 2 absent. 

 

As a matter of pending business the chair laid out SB 1726 and recognized the author, Senator West, to explain the bill.  Senator West moved that SB 1726 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.   

 

As a matter of pending business the chair laid out SB 1727 and recognized the author, Senator West, to explain the bill.  Senator West sent up a committee substitute; the chair recognized Senator West to explain the difference between the committee substitute and the senate bill as filed.  Senator West moved adoption of the committee substitute; without objection, it was so ordered.  Senator West moved that SB 1727 do not pass but that CSSB 1727 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent.  Senator West moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.    

 

As a matter of pending business the chair laid out SB 2033 by Senator Nelson.  Senator Patrick moved that SB 2033 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

As a matter of pending business the chair laid out SB 2308 and recognized the author, Senator Gallegos, Jr. to explain the bill.  Senator Gallegos, Jr. sent up a committee substitute; the chair recognized Senator Gallegos, Jr. to explain the difference between the committee substitute and the senate bill as filed.  Senator Gallegos, Jr. moved adoption of the committee substitute; without objection, it was so ordered.  Senator Gallegos, Jr. moved that SB 2308 do not pass but that CSSB 2308 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

At 8:48 a.m. Senator Patrick assumed the chair.

 

As a matter of pending business the chair laid out SB 1313 and recognized the author, Senator Shapiro, to explain the bill.  Senator Shapiro sent up a committee substitute; the chair recognized Senator Shapiro to explain the difference between the committee substitute and the senate bill as filed.  Senator Shapiro moved adoption of the committee substitute; without objection, it was so ordered.  Senator Shapiro moved that SB 1313 do not pass but that CSSB 1313 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 7 ayes, 0 nay, 0 present not voting, and 2 absent. 

 

As a matter of pending business the chair laid out SB 1460 and recognized the author, Senator Shapiro, to explain the bill.  Senator Shapiro sent up Committee Amendment 1 and moved adoption.  Senator Shapiro requested unanimous consent to roll the amendment into a committee substitute; without objection, it was so ordered.  Senator Shapiro then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Shapiro moved that SB 1460 do not pass but that CSSB 1460 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 6 ayes, 1 nay, 0 present not voting, and 2 absent. 

 

At 8:55 a.m. Senator Shapiro resumed the chair. 

 

Senator Gallegos, Jr. moved that the SB 2308 be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

Senator Patrick sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.
