Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, March 24, 2009, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:34 a.m.  The following business was transacted:

 

At 8:35 a.m. Senator Ogden assumed the chair. 

 

The chair laid out SB 1140 and recognized the author, Senator Shapiro, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Ogden moved that SB 1140 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 1364 and recognized the author, Senator Shapiro, to explain the bill. 

 

At 8:40 a.m. Senator Patrick assumed the chair.

Senator Shapiro moved that SB 1364 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 1 nay, 0 present not voting, and 0 absent.   

 

As a matter of pending business Senator Shapiro moved that SB 1140 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

At 8:57 a.m. Senator Shapiro resumed the chair. 

 

As a matter of pending business the chair laid out SB 38 and recognized Senator Van de Putte, in the absence of the author, to send up a committee substitute to SB 38; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed.

 

Senator Shapiro moved that SB 38 be left pending; without objection, it was so ordered. 

 

As a matter of pending  business the chair laid out SB 197.  Senator Averitt moved that SB 197 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Averitt moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending  business the chair laid out SB 199.  Senator Averitt moved that SB 199 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Davis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

As a matter of pending business the chair laid out SB 451 and recognized the author, Senator Van de Putte, to explain the bill.  Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed.  Senator Van de Putte moved adoption of the committee substitute; without objection, it was so ordered.  Senator Van de Putte moved that SB 451 do not pass but that CSSB 451 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

 

 

The chair laid out SB 1219 and recognized the author, Senator Averitt, to explain the bill.

Senator Van de Putte sent up a committee substitute; the chair recognized Senator Averitt to explain the difference between the committee substitute and the senate bill as filed.  Senator Averitt moved adoption of the committee substitute; without objection, it was so ordered.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Averitt moved that SB 1219 do not pass but that CSSB 1219 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.  Senator Averitt moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out SB 382 and recognized the author, Senator Van de Putte, to explain the bill. Senator West sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed.  Senator Davis moved adoption of the committee substitute; without objection, it was so ordered.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.
