Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Thursday, March 12, 2009, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:32 a.m.  The following business was transacted: 

 

The chair made opening comments to the Committee.

 

At 8:35 a.m. the roll was called, and a quorum was present.

 

Senator Patrick moved adoption of the minutes from the previous hearing held on March 3, 2009; without objection, it was so ordered. 

 

The chair laid out SB 522 and recognized the author, Senator Averitt, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Patrick moved that SB 522 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.   Senator Averitt moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

At 8:46 a.m. Senator Patrick assumed the chair. 

 

The chair laid out SB 987 and recognized the author, Senator Shapiro, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Shapiro moved that SB 987 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Shapiro moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.  

 

At 8:54 a.m. Senator Shapiro resumed the chair. 

 

The chair laid out SB 49 and recognized the author, Senator Zaffirini, to explain the bill.

Senator Shapiro sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.  Senator Shapiro requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Shapiro then moved that the committee substitute be adopted; without objection, it was so ordered. 

 

At 9:03 a.m. Senator Shapiro resumed the chair.

As a matter of pending business, the chair laid out SB 503 and Senator Shapiro, in the absence of the author, explained the bill.  Senator Averitt moved that SB 503 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

As a matter of pending business, the chair laid out SB 688 and Senator Shapiro, in the absence of the author, explained the bill and the amendments previously sent up by Senator Patrick.  Senator Patrick requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Patrick then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Shapiro moved that SB 688 be left pending; without objection, it was so ordered. 

 

As a matter of pending business, the chair laid out SB 300 and recognized the author, Senator Patrick, to explain the bill.  Senator Williams sent up a committee substitute; the chair recognized Senator Patrick to explain the difference between the committee substitute and the senate bill as filed.  Senator Williams moved adoption of the committee substitute; without objection, it was so ordered.  Senator Averitt moved that SB 300 do not pass but that CSSB 300 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 9 ayes, 0 nay, 0 present not voting, and 0 absent.

 

The chair laid out SB 451 and recognized the author, Senator Van de Putte, to explain the bill.  Senator Van de Putte sent up a committee substitute; the chair recognized Senator Van de Putte to explain the difference between the committee substitute and the senate bill as filed. 

 

The chair left the bill pending.

 

As a matter of pending business, the chair laid out SB 398 and Senator Shapiro, in the absence of the author, explained the bill.  Senator Williams sent up a committee substitute; Senator Shapiro explained the difference between the committee substitute and the senate bill as filed. Senator Averitt moved adoption of the committee substitute; without objection, it was so ordered.  Senator Averitt moved that SB 398 do not pass but that CSSB 398 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 4 nay, 0 present not voting, and 0 absent.

 

As a matter of pending business, the chair opened public testimony to SB 451. Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Shapiro moved that SB 451 be left pending; without objection, it was so ordered.    

 

The chair laid out SB 759 and recognized the author, Senator Williams, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Davis moved that SB 759 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  Senator Davis moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

Senators Davis and Gallegos requested unanimous consent to be shown voting nay on SB 398; there being no objection, it was so ordered. These votes are reflected in the final votes on the aforementioned bills.

 

The chair laid out SB 21 and recognized the author, Senator Zaffirini, to explain the bill. Senator Gallegos, Jr. sent up a committee substitute; the chair recognized Senator Zaffirini to explain the difference between the committee substitute and the senate bill as filed.  Witnesses testifying and registering on the bill are shown on the attached list. 

 

At 12:22 p.m. Senator Davis assumed the chair.

The chair moved that the public testimony be closed; without objection, it was so ordered.  Senator Shapiro moved that SB 21 be left pending; without objection, it was so ordered.

 

Senators Davis and Gallegos, Jr. requested unanimous consent to be shown voting aye on SB 300; there being no objection, it was so ordered.

 

Senator West requested unanimous consent to be shown voting nay on SB 398; there being no objection, it was so ordered.
