Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Education was held on Tuesday, February 24, 2009, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 8:35 a.m.  There being a quorum present, the following business was transacted: 

 

Senator Patrick moved adoption of the minutes from the previous hearing held on February 10, 2009; without objection, it was so ordered. 

 

The chair laid out SB 300 and recognized the author, Senator Patrick, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list. 

 

At 9:53 a.m. Senator Gallegos, Jr. assumed the chair. 

 

At 10:03 a.m. Senator Shapiro resumed the chair. 

 

Senator Shapiro moved that SB 300 be left pending; without objection, it was so ordered.  

 

 

The chair laid out SB 100 and recognized the author, Senator Lucio, Jr., to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  Senator Shapiro moved that SB 100 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 158 and recognized the author, Senator Ellis, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  Senator Shapiro moved that SB 158 be left pending; without objection, it was so ordered. 

 

The chair laid out SB 398 and recognized the author, Senator Seliger, to explain the bill.  Witnesses testifying and registering on the bill are shown on the attached list.  Senator Shapiro moved that the bill be left pending until the committee reconvened.

 

 The chair recessed the committee at 10:57 a.m.

 

At 1:09, p.m. Senator Shapiro reconvened the committee. 

 

The chair laid out SB 33 and recognized Senator Van de Putte, in the absence of the author, Senator Zaffirini, to explain the bill.  Senator Van de Putte sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted.   Senator Van de Putte sent up Committee Amendment 2 and moved adoption; without objection, the amendment was adopted. Senator Patrick requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

Senator Van de Putte then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Van de Putte moved that SB 33 do not pass but that CSSB 33 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.   

 

As a matter of pending business, the chair laid out SB 398.  Senator Gallegos, Jr. sent up a committee substitute; the chair recognized Senator Seliger to explain the difference between the committee substitute and the senate bill as filed. 

 

At 1:25 p.m. Senator Patrick assumed the chair.    

 

The chair left SB 398 be left pending.

 

At 1:31 p.m. Senator Shapiro resumed the chair. 

 

As a matter of pending business, the chair laid out SB 158.  Senator Averitt moved that SB 158 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 8 ayes, 0 nay, 0 present not voting, and 1 absent.  The chair moved that SB 158 be reported back to the full Senate with a favorable recommendation. 

 

Senator West and Senator Williams requested unanimous consent to be showing voting aye on CSSB 33, and SB 158.

 

There being no further business, at 1:32 p.m. Senator Shapiro moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
