Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Economic Development was held on Monday, May 11, 2009, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 4:27 p.m.  The following business was transacted: 

 

The chair laid out SB 2576 and recognized the author, Senator Watson, to explain the bill.

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered.  

 

Senator Harris moved that SB 2576 be left pending to await a quorum; without objection, it was so ordered. 

 

The chair laid out SB 1470 and recognized the author, Senator Gallegos, Jr., to explain the bill. 

 

Senator Harris sent up a committee substitute; the chair recognized Senator Gallegos, Jr. to explain the difference between the committee substitute and the senate bill as filed.

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

 

 

Senator Harris moved that SB 1470 be left pending; without objection, it was so ordered. 

 

The chair laid out HB 4328 and recognized Senator Watson, in the absence of the Senate sponsor, to explain the bill. 

 

Senator Watson sent up a committee substitute; the chair recognized Senator Watson to explain the difference between the committee substitute and the house bill as engrossed.

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Harris moved that HB 4328 be left pending to await a quorum; without objection, it was so ordered. 

 

The chair laid out HB 1789 and recognized Senator Watson, in the absence of the Senate sponsor, to explain the bill. 

 

Senator Watson sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

 

The chair moved that the public testimony be closed.

 

Senator Harris moved that HB 1789 be left pending to await a quorum; without objection, it was so ordered. 

 

At 4:46 p.m. Senator Harris moved that the committee stand recessed until 4:57 p.m. to await the arrival of a quorum; without objection, it was so ordered. 

 

At 4:57 p.m. the committee reconvened, the roll was called and a quorum was present.

 

The chair laid out as a matter of pending business SB 2576 and recognized the author, Senator Watson for a motion.

 

Senator Watson moved that SB 2576 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

Senator Watson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

 

 

The chair laid out as a matter of pending business HB 4328 and recognized Senator Watson for a motion.

 

Senator Watson sent up a committee substitute; Senator Watson moved adoption of the committee substitute; without objection, it was so ordered. 

 

Senator Watson moved that HB 4328 do not pass but that CSHB 4328 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business HB 1789 and recognized Senator Watson for a motion.

 

Senator Watson sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

 

Senator Watson requested unanimous consent to roll the amendments into a committee substitute; without objection, it was so ordered.  Senator Watson then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Watson moved that HB 1789 do not pass but that CSHB 1789 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

The following motion in writing was received from the following Committee member. Senator Zaffirini requested to be shown voting aye on the following Senate bill, 2576 and the following House bills, 1789 and 4328.

 

There being no further business, at 5:03 p.m. Senator Harris moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
