Pursuant to a notice posted in accordance with Senate Rule 11.18, a public hearing of the Senate Committee on Economic Development was held on Monday, May 4, 2009, in the Capitol Extension, Room E1.028, at Austin, Texas.

The chair called the meeting to order at 3:30 p.m.  The following business was transacted: 

 

The chair laid out HB 271 and recognized the Senate sponsor, Senator Van de Putte, to explain the bill. 

 

Senator Harris sent up Committee Amendment 1 and moved adoption; without objection, the amendment was adopted. 

 

The roll was called and a quorum was established.

 

The following members arrived after the roll was called:  Senator Kevin Eltife

 

Witnesses registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Harris requested unanimous consent to roll the amendment into a committee substitute; without objection, it was so ordered.  Senator Harris then moved that the committee substitute be adopted; without objection, it was so ordered.  Senator Harris moved that HB 271 do not pass but that CSHB 271 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 4 ayes, 0 nay, 0 present not voting, and 1 absent. 

 

Senator Deuell moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out HB 3519 and recognized Senator Watson, in the absence of the Senate sponsor, to explain the bill. 

 

Witnesses registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Watson moved that HB 3519 be reported favorably to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

The chair laid out SB 1770 and recognized the author, Senator Watson, to explain the bill. 

 

Senator Watson sent up a committee substitute; the chair recognized Senator Watson to explain the difference between the committee substitute and the senate bill as filed.  Senator Harris moved adoption of the committee substitute; without objection, it was so ordered. 

 

Witnesses testifying and registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Harris moved that SB 1770 be left pending; without objection, it was so ordered. 

 

Senator Harris moved to re-open HB 3519.  

 

Senator Watson moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

At 4:01 p.m. Senator Eltife assumed the chair. 

 

The chair laid out HB 2032 and recognized the Senate sponsor, Senator Harris, to explain the bill. 

 

Senator Harris sent up a committee substitute; the chair recognized Senator Harris to explain the difference between the committee substitute and the house bill as engrossed.  Senator Harris moved adoption of the committee substitute; without objection, it was so ordered. 

 

Witnesses registering on the bill are shown on the attached list. 

 

The chair moved that the public testimony be closed; without objection, it was so ordered. 

 

Senator Eltife moved that HB 2032 do not pass but that CSHB 2032 be reported back to the Senate with the recommendation that it do pass and be printed.  The motion carried with a record vote of 5 ayes, 0 nay, 0 present not voting, and 0 absent. 

 

Senator Harris moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

At 4:06 p.m. Senator Harris resumed the chair. 

 

The following motions in writing were received from the following Senators. Senator Zaffirini requested to be shown voting aye on the following House bills, 271, 2032, and 3519. Senator Deuell requested to be shown voting aye on the following House bill, 2032.

 

There being no further business, at 4:07 p.m. Senator Harris moved that the Committee stand recessed subject to the call of the chair.  Without objection, it was so ordered.
